To COMMIT any of the mistakes mentioned below is a cardinal error that will always cost the client in any type of case before the courts of law. The civil litigant might lose their right which has been violated, their remedies which they are by law entitled to receive, the criminal might face a death sentence, incarceration for life, several years in prison, custodial sentence. Several other limitations on both the civil litigant and the criminal offender under any circumstances. In any case, the loss of face (loss of reputation) or esteem on the part of the Advocate after committing such mistakes in no way equates with the loss inflicted upon your CLIENT (victim). LET US NOT FORGET.
Picking the Brains of the Legal Pundit Glanville Williams through Chapter 13 of his book, Learning the Law, at p. 190, Nyaga Mawalla; an internationally seasoned and experienced Advocate of the High Court of Tanzania refreshed the minds of the newly Admitted (286 were Admitted on The Roll on 6 July, 2012) to the Bar Advocates on 3rd August, 2012 at Ubungo Plaza, Dar es Salaam, Tanzania, East Africa, on the following; which he quoted from the said book:
"Every kind of a Lawyer needs accuracy. Your ability to write and argue is of little avail if
- you get your facts wrong;
- fail to find the relevant authorities;
- rely on a statute that has been superseded; or
- a case that has been overruled; or
- simply misunderstand the authorities.
All these mistakes are only too easy to make, and it takes constant effort to keep oneself up to the mark.
EXEMPLARY ADVICE INDEED ! LET ALL OF US LEARNED BROTHERS AND SISTERS TAKE HEED !
