Watanzania wanatamani kuwa Wamarekani

KUIGA kutoka kwa mtu aliyefanikiwa ni jambo jema, tena linakubalika pale ambapo mbinu safi zilizomfanya mhusika afanikiwe, ndizo zinazoigwa. Hivyo hata katika biashara, mtu anatakiwa ailinganishe biashara yake na ile yenye mafanikio na aangalie ni kipi anaweza kuiga na kukiingiza kwake ili naye apate mafanikio.
Vijana wanaaswa waige kutoka kwa watu wazima ambao wamekuwa na mafanikio ili nao wafuate nyayo. Hivyo kuiga kupo na ni jambo jema. Kwa kulikazia hilo kuna msemo kwamba ‘‘kwanini uhangaike kuunda gurudumu wakati tayari kuna mtu aliyekwisha liunda?’’ Huko ni kupoteza raslimali muda ambayo inahitajika sana kwa mambo mengine ambayo katika dunia hii yapo mengi.
Hivyo kuiga kwa ajili ya maendeleo mimi hakunisumbui, kinachosumbua moyo wangu ni kuiga kulikopitiliza kiasi kwamba mtu anatamani sio tu kuiga bali awe nakala ya huyo mtu anayemuiga. Kama ni suala la mtu moja moja tunaweza kusema mtu anaiga kwa kiasi ambacho anatamani kuwa nakala ya mtu mwingine, hiyo ni kumkosoa Mungu kwa kukuumba kama ulivyo.
Sijui tusemeje kama ni taifa ndilo linalotamani kuwa taifa jingine katika nchi yake yenyewe. Hapa ndipo tulipofikia Watanzania. Tunapenda kuwa Wamarekani tukiwa ndani ya Tanzania. Hali hii ipo toka kwa wasomi mpaka wasioingia darasani, taasisi binafsi mpaka zile za umma, wasanii mpaka wale wa fani zingine. Tulitafakari hili.
Sarafu ni alama moja wapo inayotambulisha taifa. Matumizi ya sarafu katika biashara kwa wakazi wa mahali fulani yanamuongoza mtu kusema kwa uhakikia kwamba, yupo kati ya watu wa taifa fulani.
Hivyo kama ni Shilingi ya Kenya, anajua kwamba yuko ndani ya mipaka ya Kenya. Kama ataigundua kuwa ni Shilingi ya Tanzania basi atajua yuko ndani ya mipaka ya Tanzania.
Umezuka mtindo ambao unakera kweli kweli; na nashukuru umma wa Watanzania umeanza kuupigia kelele, nao ni baadhi ya watu au taasisi kudai malipo kwa Dola ya Marekani badala ya shilingi kwa bidhaa na huduma wanazotoa. Hivi bila aibu mtu au taasisi inamdai Mtanzania kulipia bidhaa au huduma kwa dola katika nchi ya Tanzania, azitoe wapi na yuko kwenye uchumi wa shilingi?
Cha ajabu, haya yanafanywa hata na vitengo vya vyuo na shule ambako ulitegemea kuna wasomi wenye kuelewa vizuri kwamba sarafu ya nchi hii ni shilingi na kwamba ni shilingi ndio inayotakiwa kulindwa kwa sababu ndio yetu.
Shilingi ndio inayotutambulisha utaifa wetu. Sasa hata wasomi wanapokataa kuipokea maana yake nini? Kwamba tuingie kwenye mchakato wa kubadilisha sarafu ili tutumie Dola ya Marekani na Benki Kuu yetu iwe hiyo ya Marekani? Wasomi hawa wanatambua kwamba kudai kwao malipo kwa dola kunazidi kuizorotesha shilingi, cha ajabu hili haliwasumbui.
Natambua uimara wa dola na utamu wake katika biashara kwa mtu anayeipokea lakini hiyo sio yetu. Tutafute mbinu za kuimarisha ya kwetu. Kuibeza pesa yetu kwa kuwa ni hafifu, ni sawa na mtoto kumbeza baba yake kwa kuwa hali yake hailingani na baba wa nyumba jirani.
Jambo lingine linaloonesha matamanio yetu ya kuwa Wamarekani ni mahangaiko ya vijana wetu ya kuwa na lafudhi ya Kimarekani na kuikataa ya makabila ya Kitanzania. Lafudhi hujengeka katika matamshi ya mtu kwa muda mrefu sana. Mtu hujengeka kwa lafudhi ya jamii inayomzunguka kipindi anachokua. Hivyo akikuzwa katika mazingira ambayo watu wanazungumza kwa lafudhi ya Kihaya ya kwake pia itakuwa ya Kihaya, vivyo hivyo Kinyakyusa, Kingoni nk. Baada ya kujengeka sio rahisi kutoka.
Lafudhi sio kitu kibaya, hiki ni kitambulisho cha jamii aliyotoka mtu. Kuikataa lafudhi ni kuikana jamii iliyomkuza. Vijana wanahangaika kutumia lafudhi ya Kimarekani wakati wanapoongea Kiingereza kiasi kwamba wanaishia kumung’unya maneno, yasiyoeleweka.
Hawaeleweki kwa sababu wanajaribu kuzungumza kwa namna ambayo sio wao. Lafudhi ya mtu ipo palepale haijalishi kama mtu huyo anaongea Kiswahili, Kingereza, Kichaga nk. Hivyo mtu anapojaribu kuibadilisha kwa kuwa tu anaongea lugha ya mtu mwingine, lazima itampa shida, na ataishia kuchekesha watu.
Uigizwaji wa lafudhi tunawaachia wasanii katika michezo ya kuigiza kwani lengo lao ni kutuchekesha. Kwa lafudhi yako mtu unajulikana unatokea upande upi wa dunia, kwa lafudhi yako unapendeza, kwa lafudhi yako mtu unajiamini zaidi unapoongea, lakini kwa lafudhi ya mtu mwingine unachekesha na hueleweki. Yanini mtu uishie kuwa kichekesho wakati hiyo haikuwa nia yako?
Tunatamani kuwa Wamarekani mpaka tunapeperusha bendera yao katika nchi yetu. Kama ilivyo kwa sarafu, bendera pia ni alama ya taifa. Tanzania tunapeperusha bendera ya Marekani kwa kubandika kwenye mikokoteni, kuvaa kama vilemba, kuibandika kwenye daladala, kuitangaza kwenye fulana tunazovaa.
Hiyo ni kutamani kuwa Wamarekani , hiyo ni kasoro kubwa sana kwenye taifa letu ambalo tunasherehekea miaka 50 ya kuwa huru. Miaka 50 ya kuwa na bendera yetu wenyewe ambayo sasa tunaikana na kutamani kupeperusha ile ya Marekani.
Haya ni machache tu yanayoashiria kulikana taifa letu la Tanzania. Ukweli nchi yetu ni maskini na ni ukweli tuna kasoro nyingi za hapa na pale zinazorudisha maendeleo ya nchi nyuma, lakini kusahihisha kwake sio kwa kuikana kwa kuendelea kuzorotesha uchumi kwa kutumia sarafu isiyo yetu, au kwa kutumia lafudhi isiyo yetu au kwa kuukana uhuru wetu kwa kupeperusha bendera isiyo yetu.
Tuchangie kwa kuhakikisha nasi tunakuwa taifa ambalo wengi wa watu wake wanaishi maisha yenye neema. Tukosoane, tuwajibike na tuige mambo ambayo mataifa mengine wameyatekeleza na kuwafanya waneemeke. Lakini tubaki kama Watanzania. Kwa wale wanaoukana Utanzania wao basi wahame wakaishi na jamii za taifa hilo wanalolipenda .

UTANGULIZI
WAZEE wangu, kwanza kabisa kabla ya kueleza kile ambacho kimenisukuma kuzungumza nanyi leo,napenda kuanza kwa kumshukuru Mwenyezi Mungu,mwingi wa rehema kwa kutuwezesha kufikia siku hii ambayo inatukutanisha waja wake.
Wazee wangu wa Igunga,baada ya kufanya hivyo napenda pia kutumia fursa hii kuwashukuru ninyi nyote mmoja mmoja na katika umoja wenu kwa kuitikia wito wangu,kijana wenu, niliyewaomba nije nizungumze nanyi siku hii ya leo.
Nafanya hivyo nikitambua vyema kwamba,kama si nyinyi wazee wangu na wengine wengi ambao hatuko nao hapa leo kwa sababu mbalimbali, ambao mmekuwa na imani kubwa nami nisingeweza kufikia hapa nilipofika sasa.
Wazee wangu, waasisi wa taifa letu walitufundisha kutambua na kuheshimu ukweli kwamba; ‘Uongozi ni Dhamana’dhana ambayo kila ninapokaa na kutafakari huwa inanirejesha nyuma na kukumbuka jinsi nyinyi mlivyokaa katika umoja wenu na kuniteua mimi, miongoni mwa vijana wenu wengi, kuwa mwakilishi wa Jimbo la Igunga tangu mwaka 1994.
Katika kipindi hicho chote cha utumishi wangu,nyinyi wazee wangu mmekuwa mhimili muhimu ambao umeniwezesha kutimiza wajibu wangu kwa bidii kubwa, maarifa na nidhamu ya hali ya juu nikitambua namna ambavyo mmekuwa na imani kubwa juu yangu.
Ari na moyo wa imani, ushirikiano na mshikamano ambao wazee wangu mmekuwa nao kwangu ndiyo ambao kwa kiwango kikubwa umetuwezesha kufanya kazi kwa pamoja, tukishinda changamoto mbalimbali ambazo zimekuwa zikilikabili jimbo letu katika kipindi chote ambacho mmeendelea kuniamini kuwa mbunge wenu kwa miaka 18 sasa.
Wakati nikitambua na kuheshimu ukweli kwamba katika kipindi chote cha ubunge wangu mmekuwa na imani kubwa nami na kuniunga mkono kwa dhati, naamini kwamba kwa upande wangu pia nimejitahidi kwa kadiri nilivyoweza, kutimiza matarajio ya wananchi wa Igunga.
Miongoni mwa mafanikio makubwa tuliyoyafikia kupitia ushirikiano wetu na uongozi wa pamoja ni kwamba, mwaka 1994 Igunga ilikuwa ni wilaya ya mwisho kwa maendeleo mkoani Tabora lakini leo ndiyo ya kwanza, taa za barabarani, bima ya afya kwa kila kaya, zahanati kila kijiji na shule nyingi kuliko idadi ya kata zilizomo kwenye wilaya.
Wazee wangu, nayasema haya nikitambua kwamba, kama ilivyo katika maeneo mbalimbali hapa nchini,mafanikio makubwa tuliyoyapata katika nyanja za elimu,afya, makaazi bora na kilimo katika kipindi chote ambacho mmendelea kuniamini kuwa mbunge wenu kwa miaka 18 sasa.
Wakati nikitambua na kuheshimu ukweli kwamba katika kipindi chote cha ubunge wangu mmekuwa na imani kubwa nami na kuniunga mkono kwa dhati,naamini kwamba kwa upande wangu pia nimejitahidi kwa kadiri nilivyoweza, kutimiza matarajio ya wananchi wa Igunga.
Wazee wangu,nayasema haya nikitambua kwamba,kama ilivyo katika maeneo mbalimbali hapa nchini,mafanikio makubwa tuliyoyapata katika nyanja za elimu, afya, makaazi bora na kilimo katika kipindi hicho chote hayajaweza kumaliza changamoto zote za maendeleo ambazo zinatukabili.
Wazee wangu, ingawa nimekuwa na kawaida ya kukutana na kuzungumza nanyi mara kwa mara, mmoja mmoja na wakati mwingine katika umoja wenu, wito wangu wa leo una makusudi ambayo kwa kiwango kikubwa ni tofauti na yale ambayo tumeyazoea.
Japokuwa ujumbe ninaotaka kuzungumza nanyi wazee wangu, si mgeni sana masikioni mwenu, tofauti ya leo na mikutano yetu mingine iliyopita ni uamuzi ambao nimekusudia kuufanya na ambao nitayatangaza muda mfupi ujao.
YATOKANAYO
Wazee wangu,naamini mmekuwa mkifuatilia kwa karibu hali ya siasa nchini na hususani afya ya kisiasa na matukio mengine ndani ya Chama Cha Mapinduzi(CCM) ambacho mimi ni mwanachama wake na Mjumbe wa Halmashauri Kuu ya Taifa(NEC)nikiuwakilisha Mkoa wetu wa Tabora.
Naamini kwamba katika kufuatilia kwenu mtakuwa mmebaini kuwapo kwa matukio ambayo kwa namna moja au nyingine yamekuwa yakitokea huku yakiligusa jina langu na wakati fulani nafasi yangu kama kiongozi wa chama hicho.
Wazee wangu, nayasema hayo kwa sababu mara kwa mara ninapokutana nanyi nikiwa katika ziara zangu jimboni na wakati mwingine mnapowasiliana nami kwa njia mbalimbali mmekuwa mkionesha kuguswa kushitushwa na kutaka kujua kulikoni kuhusu mambo hayo yanayotokea.
Mimi, kama mnavyonijua nyote, ni mtu muwazi na mkweli. Siku zote nimekuwa mwepesi sana wa kuwaeleza kuhusu kila kinachotokea ili kuwaondoa hofu na wakati huo huo kuwahakikishia kwamba masuala yasiyo na msingi hususani yale yanayogusa siasa za kitaifa hayawezi kutuondoa katika mstari sahihi wa kuwahudumia wananchi wa Igunga, mkiwamo nyinyi wazee wangu ambao mmeniamini na kunituma kuwawakilisha.
Nyinyi wenyewe ni mashahidi wazuri kwamba tangu matukio yanayogusa jina langu yaanze kutokea miezi michache tu baada ya Serikali ya Awamu ya Nne inayoongozwa na Rais Jakaya Kikweti kuingia madarakani kwa mara ya kwanza mwaka 2005, tumekuwa tukiyapuuza na tukaendelea kufanya kazi pamoja kwa bidii.
Bado naamini na nitaendelea kuamini kwamba tulifanya uamuzi sahihi wa kuyapuuza matukio hayo kwani mbali ya kuendelea kutimiza malengo mbalimbali yaliyokuwamo katika Ilani yetu ya Uchaguzi ya CCM, pia mliendelea kuniamini kwa nafasi yangu ya kuwa mwakilishi wenu bungeni na hata mkaniruhusu nibebe jukumu jingine kubwa la kuwa Mjumbe wa NEC ninayewakilisha mkoa wetu wa kihistoria wa Tabora.
Wazee wangu, nyinyi ndiyo watu mnaolifahamu vyema jimbo letu la Igunga na hakika nyinyi ni sehemu muhimu ya watu wanaojua historia ya kisiasa ya Mkoa wa Tabora kwa miaka mingi hata kabla ya kuja kwa mfumo wa vyama vingi hapa nchini.
Hakuna shaka hata kidogo kwamba, Tabora ni kitovu hasa cha uasisi wa siasa za vyama vingi hapa nchini. Ni wazi kwamba huwezi ukazungumzia chimbuko la vyama vya upinzani tunavyoviona hapa nchini leo pasipo kugusa mkoa huu ambao umekuwa chimbuko la wanasiasa wenye mizizi hapa na nchini kwa ujumla.
Majina ya wanasiasa wa aina ya wazee wetu, hayati Chifu Said Abdallah Fundikira na Christopher Kassanga Tumbo, Kasela Bantu (Mungu awalaze mahala pema peponi), James Mapalala, Profesa Ibrahim Lipumba na mengi mengine yana mizizi yao katika Mkoa wetu wa Tabora.
Kutokana na ukweli huo basi ni wazi kwamba, nikiwa Mbunge wa Igunga kwa vipindi vinne mfululizo na wakati huo huo nikiwa Mjumbe wa NEC kwa vipindi vitatu mfululizo, moja ya kazi ambazo nimezifanya kwa uaminifu na kwa bidii kubwa huku nikiungwa mkono na kushirikiana nanyi ni ile ya kuhakikisha kwamba mkoa huu pamoja na kuwa kitovu cha upinzani unaendelea kubakia kuwa ngome muhimu ya kisiasa ya CCM.
Si vibaya tukakumbushana kwamba, wakati nachaguliwa kuwa mjumbe wa NEC wa Mkoa mwaka 1997, jimbo moja katika mkoa wetu lilikuwa likishikiliwa na upinzani. Leo hii Tabora ni mkoa pekee miongoni mwa mikoa iliyotuzunguka ambao haukupoteza jimbo hata moja kwenda upinzani katika Uchaguzi Mkuu wa 2010. Mafanikio haya tuliyafikia kwa pamoja kutokana na ushirikiano wenu wazee wangu.
Wazee wangu, Waswahili wanasema usione vyaelea, vimeundwa. Kazi ya kuijenga CCM katika mazingira yenye mizizi hasa ya upinzani nikiwa mbunge na hususani M-NEC kutoka Mkoa wa Tabora haijapata kuwa rahisi na itaendelea kuwa ngumu na ambayo mapambano yake ni makali sana.
Wazee wangu, kwa namna ya pekee kabisa napenda kuchukua fursa hii kuwashukuru nyinyi wazee wangu wa Igunga na wananchi wenzangu wote wa Mkoa wa Tabora kwa kushikamana na kuifanya kazi hiyo kwa bidii, uaminifu na mafanikio makubwa.
Matunda ya kazi hiyo kubwa yanaonekana. Pamoja na kuwa kitovu cha kihistoria cha siasa za upinzani, Tabora ndiyo mkoa pekee katika eneo hili ambao unaongozwa na wabunge wote kutoka CCM baada ya Uchaguzi Mkuu wa 2010 na hata kabla ya hapo.
Kwa sababu hiyo basi, wazee wangu, sote katika umoja wetu ukiacha mafanikio makubwa tuliyopata katika jimbo na Wilaya yetu ya Igunga, tunayo mambo mengine ya msingi ya kujivunia. Kwa moyo wa dhati na kwa unyenyekevu mkubwa napenda kuwapongeza kwa namna mlivyojitoa kukipigania na kukitetea chama chetu kwa ari na nguvu ya kipekee.
KUJIVUA GAMBA
Wazee wangu,chama chetu chini ya uongozi wa Mwenyekiti wake,Rais Jakaya Kikwete kimeamua kwa kauli na nia moja kujitathmini na kufanya mabadiliko makubwa ya kimfumo yenye lengo la kukiwezesha kiendelee kubakia chama kinachoaminiwa na kuungwa mkono na Watanzania walio wengi.
Dhamira ya mwelekeo huo wa kufanya mabadiliko ya ndani ya chama chetu ilitangazwa rasmi na Mwenyekiti wetu Rais Kikwete wakati wa kilele cha maadhimisho ya miaka 34 ya kuzaliwa kwa CCM, mjini Dodoma.
Katika hotuba yake hiyo, Rais Kikwete aliyafananisha mabadiliko hayo na tabia ya kawaida na ya asili ya nyoka na wanyama wengine kadhaa ya ‘Kujivua Gamba’.
Wazee wangu hatua ya kwanza ya utekelezaji wa azimio hilo na mwelekeo huo sahihi ilifanyika mjini Dodoma wakati wa kikao cha Kamati Kuu ya Taifa ya CCM ambacho mimi nilikuwa mjumbe wake.
Wakati wa kikao hicho, wajumbe wote wa Kamati Kuu na wale wa Sekretarieti ya chama chetu wa wakati huo kwa kauli moja tulikubaliana kujiuzulu, lengo likiwa ni kumpa Mwenyekiti wetu fursa nzuri ya kufanya mabadiliko ya uongozi yatakayotoa nafasi ya kupata mwelekeo mpya wa Chama.
Wazee wangu, tulifanya hivyo tukionesha kuunga mkono kwa asilimia 100 kile ambacho bado naendelea kuamini kuwa ni mawazo sahihi na yenye mwelekeo thabiti ya Mwenyekiti wetu ambayo kwa kiwango kikubwa yalikuwa yakiakisi matokeo ya Uchaguzi Mkuu wa urais, ubunge na udiwani wa Oktoba mwaka jana.
Niliseme kwa maneno machache tu hili. Ingawa ni kweli kwamba Uchaguzi Mkuu wa mwaka jana umekirudisha madarakani chama chetu kwa kukipa ushindi mkubwa katika uchaguzi wa urais, ubunge na udiwani kwa Tanzania Bara na Zanzibar, kiwango cha ushindi tulichopata kimeonyesha waziwazi dalili za wananchi kupunguza imani yao kwetu kuilinganisha na ilivyokuwa mwaka 2005.
Tungekuwa ni chama cha siasa cha ovyo iwapo tungepuuza kupungua kwa kura za rais kutoka zaidi ya asilimia 80 tulizopata mwaka 2005 hadi kufikia aislimia 61 mwaka jana kiwango ambacho ni pungufu kwa asilimia 20 ya kura katika kipindi cha miaka mitano tu, hasa ikizingatia ukweli kwamba mgombea urais ni mtu yule yule.
Tungekuwa ni chama cha siasa kilichokosa umakini iwapo tungekaa pasipo kuchukua hatua zozote za kujiimarisha baada ya matokeo ya Uchaguzi Mkuu kuonesha wazi kukua kwa upinzani ambao umeongeza idadi ya wabunge na madiwani katika pande zote mbili za muungano.
Matokeo hayo ya uchaguzi ambayo hapana shaka yamekitikisa chama chetu yalitukumbusha wasia ambao tuliachiwa na Baba wa Taifa aliyesema; ‘Bila ya CCM Madhubuti Nchi Yetu Itayumba’.
Wazee wangu, kwa sababu ya kutambua ukweli kwamba hakuna haki isiyo na wajibu kama nilivyosema awali, mimi na wenzangu tuliokuwa katika Kamati Kuu tuliona ulazima, haja na umuhimu wa kukubali kwa kauli moja wito wa kututaka tujiuzulu ikiwa ni hatua moja ya kujipanga na kukijenga upya chama chetu.
KUJIVUA GAMBA KWAPOTOSHWA
Wazee wangu, kilichotokea baada ya kujiuzulu kwetu kila aliye ndani na nje ya chama chetu amekisikia na anakifahamu. Chama kilipata safu mpya ya uongozi iliyotokana na kuundwa kwa Sekretarieti inayoongozwa na Katibu Mkuu wetu mpya, Mhe. Wilson Mukama, na Kamati Kuu iliyokuwa na sura tofauti na ile ya awali.
Wakati tukitafakari na kuangalia mustakabali mpya wa kisiasa ndani ya chama chetu, ghafla yalianza kutokea mambo ambayo chokochoko zake zilianza kusikika tangu tukiwa ndani ya Kamati Kuu ambayo ilijiuzulu baadaye.
Mara tu baada ya kumalizika kwa kikao cha Halmashauri Kuu ya Taifa ambacho kilichagua wajumbe wapya wa Kamati Kuu na kuidhinisha uundwaji wa Sekretarieti mpya, dhana ya kujivua gamba ambayo naamini Mwenyekiti wetu aliianzisha kwa nia njema ilianza kuenezwa ikichukua tafsiri na mwelekeo tofauti na ule wa awali.
Wajumbe wawili wa Sekretarieti, Naibu Katibu Mkuu (Tanzania Bara), Mhe. John Chiligati, na Katibu wa Idara ya Itikadi na Uenezi, Mhe. Nape Nnauye, walisikika wakitangaza kwamba Halmashauri Kuu ya Taifa ilikuwa imefikia uamuzi wa kuwapa siku tisini wale walioitwa watuhumiwa wanaokabiliwa na tuhuma za ufisadi ndani ya chama kujitoa katika nafasi zao za uongozi vinginevyo watafukuzwa na chama.
Wazee wangu, baada ya kushinikizwa sana na vyombo vya habari wawataje kwa majina wanasiasa waliokuwa wakituhumiwa kwa ufisadi ambao ni wajumbe wa NEC na ambao wanapaswa kujiuzulu nyadhifa zao, wajumbe hao wa Sekretarieti walikwenda mbele zaidi.
Baada ya awali kuwaeleza waandishi wa habari kwamba majina ya watuhumiwa hao yalikuwa yakifahamika kutokana na kuhusishwa katika kashfa tofauti kama zile za Richmond, EPA na ununuzi wa rada, mwishoni viongozi hao walikaririwa wakiyataja majina ya wanasiasa watatu kuwa ndiyo ambao walikuwa wakilengwa na maamuzi hayo.
Wazee wangu, nilishangazwa na kushitushwa na namna porojo na fitina za kisiasa zilivyofinyangwa kwa mara nyingine tena baada ya kusikia jina la mbunge wenu ambaye ni mimi, likitajwa kuwa miongoni mwa yale matatu ya viongozi waliokuwa wakitakiwa eti kupima wenyewe na kisha kuchukua uamuzi wa kujiuzulu nafasi zao za uongozi ndani ya NEC katika kipindi cha siku tisini.
Niliseme hili mapema. Mshangao na mshituko wangu haukusababishwa na kutajwa kwa jina langu, la hasha, bali namna uamuzi halisi wa NEC na hususani dhana nzima ya ‘kujivua gamba’ ilivyoweza kupindishwa na wajanja wachache na kisha kuendeshwa kwa maslahi binafsi ya kikundi fulani cha watu.
Pili, nilishangazwa na kushitushwa na hatua ya viongozi wa chama changu ambacho nimekitumikia kwa bidii na uaminifu mkubwa kufanya juhudi kubwa hata kukivisha kikao kitukufu cha NEC uamuzi ambao msingi wa hoja zake ni vita vya kimakundi ya kisiasa yaliyo ndani ya CCM kwa upande mmoja na propaganda za vyama vya siasa vya upinzani na vyombo vya habari kwa upande mwingine.
Tatu, nilishangazwa na kushitushwa na ujasiri ambao umekuwa ukioneshwa na baadhi ya viongozi wetu wapya wa Sekretarieti wanaolitaja jina langu na kulihusisha na kile wanachokiita ufisadi ambao hata ukweli wa kimazingira na kihistoria ukiachilia mbali ushahidi wa wazi umeshathibitisha kwamba ni porojo za kisiasa zilizotokana na makovu na matarajio ya Uchaguzi Mkuu wa mwaka 2005 na ule ujao wa 2015.
Wazee wangu, nyinyi ni mashahidi kwamba, mbali ya mimi mwenyewe kujitokeza kupitia vyombo vya habari na kueleza wazi kwamba sijapata kujihusisha katika vitendo vyovyote vya ukiukwaji wa maadili ya uongozi au vya rushwa, hakuna ushahidi wowote uliotolewa unaonihusisha na kashfa yoyote miongoni mwa zile zilizotajwa.
Wazee wangu, ni wazi kwamba kama chama chenye siasa chenye dhamana ya kuwaoongoza Watanzania kutoka katika lindi la ufukara, maradhi, matatizo ya makaazi na mengineyo siku zote tunapaswa kuwa makini katika kuhakikisha kwamba changamoto za kuwaongoza na kuwakomboa wananchi waliotupa dhamana hazitikiswi na mawimbi ya matakwa ya nyakati ama ya vyombo vya habari au wapinzani wetu wa kisiasa walio nje ya CCM.
Ni kwa sababu ya kulitambua hilo na hasa kuyatambua madhara yanayoweza kukipata chama chetu na nchi yetu iwapo tutaendekeza siasa za kupakana matope pasipo na sababu za msingi, kuchafuana kusikokoma na kulipizana kisasi ndiyo maana nimeona nitumie fursa hii kuzungumza nanyi wazee wangu ili kuweka kumbukumbu sahihi.
MAAMUZI YANGU
Wazee wangu, nimetafakari sana na kimsingi nimefikia hatua ya kupima yale ambayo yamekuwa yakisemwa na kuandikwa juu yangu na ambayo kwa mtazamo wangu unaoungwa mkono na wanafamilia yangu, marafiki zangu na washirika wangu wa kibiashara walio ndani na nje ya nchi, naona umefika wakati muafaka wa kuchukua hatua.
Kwa sababu ya kutambua uzito wa hatua ninazokusudia kuzichukua, niliona halitakuwa jambo la hekima hata kidogo iwapo ningefanya hivyo pahala pengine popote bali hapa Igunga mbele ya nyie wazee wangu.
Baada ya kukaa na wanafamilia yangu, marafiki na washirika wangu wa kibiashara niliona halitakuwa jambo la busara hata kidogo kuendelea kuvutana na viongozi wa chama changu na wanachama wenzangu wa CCM katika mambo ambayo yanaweza kumalizwa kwa njia muafaka.
Wazee wangu, sina budi niwaeleze kwamba, mbali ya athari za kisiasa na kifamilia, vita vya ovyo vya kisiasa kama hivi tunavyoviendesha na kuviendeleza ndani ya CCM na ndani ya nchi yetu huwa vina athari kubwa katika ulimwengu wa kibiashara. Athari kama hizo za kibiashara huingia ndani zaidi kuliko vichwa vya habari vya magazeti vinavyolenga kuchafuana, na athari hizo huwa kubwa zaidi kwa mtu kama mimi kwa sababu tofauti na wengine wengi hapa nchini, mimi ni mfanyabiashara wa kimataifa.
Katika ulimwengu wa kibiashara wa leo, vita hivi ambavyo vinaweza kuonekana kuwa ni vidogo tu vyenye malengo ya kuchafuana kisiasa, vinakuwa na athari kubwa katika uhusiano wa kibiashara kuliko hata wale wasioelewa wanavyoweza kukadiria. Ndiyo maana nimeona ni afadhali sasa niwape nafasi wale wanaoendesha siasa hizi uchwara na zisizo na tija waendelee na siasa zao hizo ambazo kwa bahati mbaya kwao, mimi sina muda nazo na siwezi kuwa sehemu yake. Na mimi kwa upande wangu niendelee na maisha yangu.
Kutokana na ukweli huo na sababu zote hizo basi, kwa moyo wa dhati na kwa nia thabiti, hatua ya kwanza niliyoiona kuwa ninapaswa kuichukua ilikuwa ni hii ya kuitikia wito unaotokana na msukumo wa ndani ya nafsi yangu wa kuamua kukomesha kabisa malumbano na mivutano isiyo na manufaa kwangu binafsi, kwa viongozi wa chama changu na chama chenyewe.
Msukumo huo si mwingine bali ni ule wa kuamua kuachia nafasi zangu zote za uongozi ndani ya chama, nikianzia na ile ya ujumbe wa Halmashauri Kuu ya Taifa nikiuwakilisha Mkoa wa Tabora na hii ya ubunge wa Igunga ambazo kama si kwa baraka za chama changu nisingelikuwa nazo.
Napenda kuliweka hili sawa sawa. Uamuzi wangu wa kuachia nafasi zangu zote za uongozi nilizopata kwa tiketi ya CCM haukutokana na wala haumaanishi kukubaliana na shinikizo lililopotoshwa kuhusu azma ya utekelezaji wa dhana ya kujivua gamba, la hasha, bali dhamira ya dhati ya kuachana na siasa hizi uchwara (gutter politics) na kutumia muda wangu kushughulika na biashara zangu.
Aidha, nimefikia uamuzi huo lengo likiwa ni kuwajengea heshima na imani machoni mwa wanachama na wananchi wengine, viongozi wangu ambao naamini baada ya mimi kujitoa watapata fursa ya kutafakari upya changamoto nyingine mbadala zinazowakabili ambazo msingi wake ni dhamana kubwa walizo nazo za kukiongoza chama chetu na nchi yetu kupitia Serikali yake.
Wakati nachukua uamuzi huu, natambua vyema kwamba, watatokea watu ndani ya chama chetu na nje ambao watafanya kila juhudi kupotosha au kupindisha ukweli kuhusu hatima yangu ya kisiasa baada ya kujiweka kando na kujipa mimi mwenyewe na chama changu fursa ya kutafakari kwa kina majaaliwa yangu na ya nchi yangu katika siku zijazo.
Nafanya hivyo nikiwa na imani thabiti kwamba, uamuzi wangu huu, hususani ule wa kuachia nafasi yangu ya ubunge, yatakipa fursa nyingine CCM ya kuendelea kuliongoza jimbo letu la Igunga katika kipindi cha miaka minne ijayo kabla ya Uchaguzi Mkuu wa mwaka 2015.
Kwa upande mwingine, uamuzi wangu huu naona ni fursa kwa viongozi wa Chama changu cha CCM kutafakari na kuamua njia wanayoiona wao ni sahihi kuichukua kwa hatima na mustakabali wa chama chetu na ambayo wanaamini itakipa nguvu mpya ya kisiasa dhidi ya vyama vya upinzani.
Sambamba na hilo, ninayo imani thabiti kwamba, uamuzi wangu wa kubakia kuwa mwanachama wa kawaida na mtiifu wa CCM utakuwa chachu kwa chama changu na kwa Serikali yake kuwatumikia wananchi kwa Ari Zaidi, Kasi Zaidi na Nguvu Zaidi.
Mwisho kabisa, nikimalizia naomba nitumie fursa hii kutoa heshima za pekee kwa Rais Jakaya Kikwete kwa kazi kubwa aliyoifanyia na anayoendelea kuifanyia nchi yetu. Amefanya mengi na makubwa kuiendeleza nchi yetu na watu wake kuliko inavyothaminiwa na kufahamika. Kazi yake kubwa inashindwa kuthaminiwa na kufahamika kutokana na siasa chafu tunazoziendesha Tanzania. Wasia wangu kwa wanasiasa wenzangu, waandishi wa habari na Watanzania wenzangu kwa ujumla ni kuwa tunahitaji kuisaidia nchi yetu kwa kufanya siasa zenye mwelekeo wa kujenga ambazo ndiyo hasa zinapaswa kuwa siasa kwa maana halisi ya neno hilo.

UTANGULIZI
WAZEE wangu, kwanza kabisa kabla ya kueleza kile ambacho kimenisukuma kuzungumza nanyi leo,napenda kuanza kwa kumshukuru Mwenyezi Mungu,mwingi wa rehema kwa kutuwezesha kufikia siku hii ambayo inatukutanisha waja wake.
Wazee wangu wa Igunga,baada ya kufanya hivyo napenda pia kutumia fursa hii kuwashukuru ninyi nyote mmoja mmoja na katika umoja wenu kwa kuitikia wito wangu,kijana wenu, niliyewaomba nije nizungumze nanyi siku hii ya leo.
Nafanya hivyo nikitambua vyema kwamba,kama si nyinyi wazee wangu na wengine wengi ambao hatuko nao hapa leo kwa sababu mbalimbali, ambao mmekuwa na imani kubwa nami nisingeweza kufikia hapa nilipofika sasa.
Wazee wangu, waasisi wa taifa letu walitufundisha kutambua na kuheshimu ukweli kwamba; ‘Uongozi ni Dhamana’dhana ambayo kila ninapokaa na kutafakari huwa inanirejesha nyuma na kukumbuka jinsi nyinyi mlivyokaa katika umoja wenu na kuniteua mimi, miongoni mwa vijana wenu wengi, kuwa mwakilishi wa Jimbo la Igunga tangu mwaka 1994.
Katika kipindi hicho chote cha utumishi wangu,nyinyi wazee wangu mmekuwa mhimili muhimu ambao umeniwezesha kutimiza wajibu wangu kwa bidii kubwa, maarifa na nidhamu ya hali ya juu nikitambua namna ambavyo mmekuwa na imani kubwa juu yangu.
Ari na moyo wa imani, ushirikiano na mshikamano ambao wazee wangu mmekuwa nao kwangu ndiyo ambao kwa kiwango kikubwa umetuwezesha kufanya kazi kwa pamoja, tukishinda changamoto mbalimbali ambazo zimekuwa zikilikabili jimbo letu katika kipindi chote ambacho mmeendelea kuniamini kuwa mbunge wenu kwa miaka 18 sasa.
Wakati nikitambua na kuheshimu ukweli kwamba katika kipindi chote cha ubunge wangu mmekuwa na imani kubwa nami na kuniunga mkono kwa dhati, naamini kwamba kwa upande wangu pia nimejitahidi kwa kadiri nilivyoweza, kutimiza matarajio ya wananchi wa Igunga.
Miongoni mwa mafanikio makubwa tuliyoyafikia kupitia ushirikiano wetu na uongozi wa pamoja ni kwamba, mwaka 1994 Igunga ilikuwa ni wilaya ya mwisho kwa maendeleo mkoani Tabora lakini leo ndiyo ya kwanza, taa za barabarani, bima ya afya kwa kila kaya, zahanati kila kijiji na shule nyingi kuliko idadi ya kata zilizomo kwenye wilaya.
Wazee wangu, nayasema haya nikitambua kwamba, kama ilivyo katika maeneo mbalimbali hapa nchini,mafanikio makubwa tuliyoyapata katika nyanja za elimu,afya, makaazi bora na kilimo katika kipindi chote ambacho mmendelea kuniamini kuwa mbunge wenu kwa miaka 18 sasa.
Wakati nikitambua na kuheshimu ukweli kwamba katika kipindi chote cha ubunge wangu mmekuwa na imani kubwa nami na kuniunga mkono kwa dhati,naamini kwamba kwa upande wangu pia nimejitahidi kwa kadiri nilivyoweza, kutimiza matarajio ya wananchi wa Igunga.
Wazee wangu,nayasema haya nikitambua kwamba,kama ilivyo katika maeneo mbalimbali hapa nchini,mafanikio makubwa tuliyoyapata katika nyanja za elimu, afya, makaazi bora na kilimo katika kipindi hicho chote hayajaweza kumaliza changamoto zote za maendeleo ambazo zinatukabili.
Wazee wangu, ingawa nimekuwa na kawaida ya kukutana na kuzungumza nanyi mara kwa mara, mmoja mmoja na wakati mwingine katika umoja wenu, wito wangu wa leo una makusudi ambayo kwa kiwango kikubwa ni tofauti na yale ambayo tumeyazoea.
Japokuwa ujumbe ninaotaka kuzungumza nanyi wazee wangu, si mgeni sana masikioni mwenu, tofauti ya leo na mikutano yetu mingine iliyopita ni uamuzi ambao nimekusudia kuufanya na ambao nitayatangaza muda mfupi ujao.
YATOKANAYO
Wazee wangu,naamini mmekuwa mkifuatilia kwa karibu hali ya siasa nchini na hususani afya ya kisiasa na matukio mengine ndani ya Chama Cha Mapinduzi(CCM) ambacho mimi ni mwanachama wake na Mjumbe wa Halmashauri Kuu ya Taifa(NEC)nikiuwakilisha Mkoa wetu wa Tabora.
Naamini kwamba katika kufuatilia kwenu mtakuwa mmebaini kuwapo kwa matukio ambayo kwa namna moja au nyingine yamekuwa yakitokea huku yakiligusa jina langu na wakati fulani nafasi yangu kama kiongozi wa chama hicho.
Wazee wangu, nayasema hayo kwa sababu mara kwa mara ninapokutana nanyi nikiwa katika ziara zangu jimboni na wakati mwingine mnapowasiliana nami kwa njia mbalimbali mmekuwa mkionesha kuguswa kushitushwa na kutaka kujua kulikoni kuhusu mambo hayo yanayotokea.
Mimi, kama mnavyonijua nyote, ni mtu muwazi na mkweli. Siku zote nimekuwa mwepesi sana wa kuwaeleza kuhusu kila kinachotokea ili kuwaondoa hofu na wakati huo huo kuwahakikishia kwamba masuala yasiyo na msingi hususani yale yanayogusa siasa za kitaifa hayawezi kutuondoa katika mstari sahihi wa kuwahudumia wananchi wa Igunga, mkiwamo nyinyi wazee wangu ambao mmeniamini na kunituma kuwawakilisha.
Nyinyi wenyewe ni mashahidi wazuri kwamba tangu matukio yanayogusa jina langu yaanze kutokea miezi michache tu baada ya Serikali ya Awamu ya Nne inayoongozwa na Rais Jakaya Kikweti kuingia madarakani kwa mara ya kwanza mwaka 2005, tumekuwa tukiyapuuza na tukaendelea kufanya kazi pamoja kwa bidii.
Bado naamini na nitaendelea kuamini kwamba tulifanya uamuzi sahihi wa kuyapuuza matukio hayo kwani mbali ya kuendelea kutimiza malengo mbalimbali yaliyokuwamo katika Ilani yetu ya Uchaguzi ya CCM, pia mliendelea kuniamini kwa nafasi yangu ya kuwa mwakilishi wenu bungeni na hata mkaniruhusu nibebe jukumu jingine kubwa la kuwa Mjumbe wa NEC ninayewakilisha mkoa wetu wa kihistoria wa Tabora.
Wazee wangu, nyinyi ndiyo watu mnaolifahamu vyema jimbo letu la Igunga na hakika nyinyi ni sehemu muhimu ya watu wanaojua historia ya kisiasa ya Mkoa wa Tabora kwa miaka mingi hata kabla ya kuja kwa mfumo wa vyama vingi hapa nchini.
Hakuna shaka hata kidogo kwamba, Tabora ni kitovu hasa cha uasisi wa siasa za vyama vingi hapa nchini. Ni wazi kwamba huwezi ukazungumzia chimbuko la vyama vya upinzani tunavyoviona hapa nchini leo pasipo kugusa mkoa huu ambao umekuwa chimbuko la wanasiasa wenye mizizi hapa na nchini kwa ujumla.
Majina ya wanasiasa wa aina ya wazee wetu, hayati Chifu Said Abdallah Fundikira na Christopher Kassanga Tumbo, Kasela Bantu (Mungu awalaze mahala pema peponi), James Mapalala, Profesa Ibrahim Lipumba na mengi mengine yana mizizi yao katika Mkoa wetu wa Tabora.
Kutokana na ukweli huo basi ni wazi kwamba, nikiwa Mbunge wa Igunga kwa vipindi vinne mfululizo na wakati huo huo nikiwa Mjumbe wa NEC kwa vipindi vitatu mfululizo, moja ya kazi ambazo nimezifanya kwa uaminifu na kwa bidii kubwa huku nikiungwa mkono na kushirikiana nanyi ni ile ya kuhakikisha kwamba mkoa huu pamoja na kuwa kitovu cha upinzani unaendelea kubakia kuwa ngome muhimu ya kisiasa ya CCM.
Si vibaya tukakumbushana kwamba, wakati nachaguliwa kuwa mjumbe wa NEC wa Mkoa mwaka 1997, jimbo moja katika mkoa wetu lilikuwa likishikiliwa na upinzani. Leo hii Tabora ni mkoa pekee miongoni mwa mikoa iliyotuzunguka ambao haukupoteza jimbo hata moja kwenda upinzani katika Uchaguzi Mkuu wa 2010. Mafanikio haya tuliyafikia kwa pamoja kutokana na ushirikiano wenu wazee wangu.
Wazee wangu, Waswahili wanasema usione vyaelea, vimeundwa. Kazi ya kuijenga CCM katika mazingira yenye mizizi hasa ya upinzani nikiwa mbunge na hususani M-NEC kutoka Mkoa wa Tabora haijapata kuwa rahisi na itaendelea kuwa ngumu na ambayo mapambano yake ni makali sana.
Wazee wangu, kwa namna ya pekee kabisa napenda kuchukua fursa hii kuwashukuru nyinyi wazee wangu wa Igunga na wananchi wenzangu wote wa Mkoa wa Tabora kwa kushikamana na kuifanya kazi hiyo kwa bidii, uaminifu na mafanikio makubwa.
Matunda ya kazi hiyo kubwa yanaonekana. Pamoja na kuwa kitovu cha kihistoria cha siasa za upinzani, Tabora ndiyo mkoa pekee katika eneo hili ambao unaongozwa na wabunge wote kutoka CCM baada ya Uchaguzi Mkuu wa 2010 na hata kabla ya hapo.
Kwa sababu hiyo basi, wazee wangu, sote katika umoja wetu ukiacha mafanikio makubwa tuliyopata katika jimbo na Wilaya yetu ya Igunga, tunayo mambo mengine ya msingi ya kujivunia. Kwa moyo wa dhati na kwa unyenyekevu mkubwa napenda kuwapongeza kwa namna mlivyojitoa kukipigania na kukitetea chama chetu kwa ari na nguvu ya kipekee.
KUJIVUA GAMBA
Wazee wangu,chama chetu chini ya uongozi wa Mwenyekiti wake,Rais Jakaya Kikwete kimeamua kwa kauli na nia moja kujitathmini na kufanya mabadiliko makubwa ya kimfumo yenye lengo la kukiwezesha kiendelee kubakia chama kinachoaminiwa na kuungwa mkono na Watanzania walio wengi.
Dhamira ya mwelekeo huo wa kufanya mabadiliko ya ndani ya chama chetu ilitangazwa rasmi na Mwenyekiti wetu Rais Kikwete wakati wa kilele cha maadhimisho ya miaka 34 ya kuzaliwa kwa CCM, mjini Dodoma.
Katika hotuba yake hiyo, Rais Kikwete aliyafananisha mabadiliko hayo na tabia ya kawaida na ya asili ya nyoka na wanyama wengine kadhaa ya ‘Kujivua Gamba’.
Wazee wangu hatua ya kwanza ya utekelezaji wa azimio hilo na mwelekeo huo sahihi ilifanyika mjini Dodoma wakati wa kikao cha Kamati Kuu ya Taifa ya CCM ambacho mimi nilikuwa mjumbe wake.
Wakati wa kikao hicho, wajumbe wote wa Kamati Kuu na wale wa Sekretarieti ya chama chetu wa wakati huo kwa kauli moja tulikubaliana kujiuzulu, lengo likiwa ni kumpa Mwenyekiti wetu fursa nzuri ya kufanya mabadiliko ya uongozi yatakayotoa nafasi ya kupata mwelekeo mpya wa Chama.
Wazee wangu, tulifanya hivyo tukionesha kuunga mkono kwa asilimia 100 kile ambacho bado naendelea kuamini kuwa ni mawazo sahihi na yenye mwelekeo thabiti ya Mwenyekiti wetu ambayo kwa kiwango kikubwa yalikuwa yakiakisi matokeo ya Uchaguzi Mkuu wa urais, ubunge na udiwani wa Oktoba mwaka jana.
Niliseme kwa maneno machache tu hili. Ingawa ni kweli kwamba Uchaguzi Mkuu wa mwaka jana umekirudisha madarakani chama chetu kwa kukipa ushindi mkubwa katika uchaguzi wa urais, ubunge na udiwani kwa Tanzania Bara na Zanzibar, kiwango cha ushindi tulichopata kimeonyesha waziwazi dalili za wananchi kupunguza imani yao kwetu kuilinganisha na ilivyokuwa mwaka 2005.
Tungekuwa ni chama cha siasa cha ovyo iwapo tungepuuza kupungua kwa kura za rais kutoka zaidi ya asilimia 80 tulizopata mwaka 2005 hadi kufikia aislimia 61 mwaka jana kiwango ambacho ni pungufu kwa asilimia 20 ya kura katika kipindi cha miaka mitano tu, hasa ikizingatia ukweli kwamba mgombea urais ni mtu yule yule.
Tungekuwa ni chama cha siasa kilichokosa umakini iwapo tungekaa pasipo kuchukua hatua zozote za kujiimarisha baada ya matokeo ya Uchaguzi Mkuu kuonesha wazi kukua kwa upinzani ambao umeongeza idadi ya wabunge na madiwani katika pande zote mbili za muungano.
Matokeo hayo ya uchaguzi ambayo hapana shaka yamekitikisa chama chetu yalitukumbusha wasia ambao tuliachiwa na Baba wa Taifa aliyesema; ‘Bila ya CCM Madhubuti Nchi Yetu Itayumba’.
Wazee wangu, kwa sababu ya kutambua ukweli kwamba hakuna haki isiyo na wajibu kama nilivyosema awali, mimi na wenzangu tuliokuwa katika Kamati Kuu tuliona ulazima, haja na umuhimu wa kukubali kwa kauli moja wito wa kututaka tujiuzulu ikiwa ni hatua moja ya kujipanga na kukijenga upya chama chetu.
KUJIVUA GAMBA KWAPOTOSHWA
Wazee wangu, kilichotokea baada ya kujiuzulu kwetu kila aliye ndani na nje ya chama chetu amekisikia na anakifahamu. Chama kilipata safu mpya ya uongozi iliyotokana na kuundwa kwa Sekretarieti inayoongozwa na Katibu Mkuu wetu mpya, Mhe. Wilson Mukama, na Kamati Kuu iliyokuwa na sura tofauti na ile ya awali.
Wakati tukitafakari na kuangalia mustakabali mpya wa kisiasa ndani ya chama chetu, ghafla yalianza kutokea mambo ambayo chokochoko zake zilianza kusikika tangu tukiwa ndani ya Kamati Kuu ambayo ilijiuzulu baadaye.
Mara tu baada ya kumalizika kwa kikao cha Halmashauri Kuu ya Taifa ambacho kilichagua wajumbe wapya wa Kamati Kuu na kuidhinisha uundwaji wa Sekretarieti mpya, dhana ya kujivua gamba ambayo naamini Mwenyekiti wetu aliianzisha kwa nia njema ilianza kuenezwa ikichukua tafsiri na mwelekeo tofauti na ule wa awali.
Wajumbe wawili wa Sekretarieti, Naibu Katibu Mkuu (Tanzania Bara), Mhe. John Chiligati, na Katibu wa Idara ya Itikadi na Uenezi, Mhe. Nape Nnauye, walisikika wakitangaza kwamba Halmashauri Kuu ya Taifa ilikuwa imefikia uamuzi wa kuwapa siku tisini wale walioitwa watuhumiwa wanaokabiliwa na tuhuma za ufisadi ndani ya chama kujitoa katika nafasi zao za uongozi vinginevyo watafukuzwa na chama.
Wazee wangu, baada ya kushinikizwa sana na vyombo vya habari wawataje kwa majina wanasiasa waliokuwa wakituhumiwa kwa ufisadi ambao ni wajumbe wa NEC na ambao wanapaswa kujiuzulu nyadhifa zao, wajumbe hao wa Sekretarieti walikwenda mbele zaidi.
Baada ya awali kuwaeleza waandishi wa habari kwamba majina ya watuhumiwa hao yalikuwa yakifahamika kutokana na kuhusishwa katika kashfa tofauti kama zile za Richmond, EPA na ununuzi wa rada, mwishoni viongozi hao walikaririwa wakiyataja majina ya wanasiasa watatu kuwa ndiyo ambao walikuwa wakilengwa na maamuzi hayo.
Wazee wangu, nilishangazwa na kushitushwa na namna porojo na fitina za kisiasa zilivyofinyangwa kwa mara nyingine tena baada ya kusikia jina la mbunge wenu ambaye ni mimi, likitajwa kuwa miongoni mwa yale matatu ya viongozi waliokuwa wakitakiwa eti kupima wenyewe na kisha kuchukua uamuzi wa kujiuzulu nafasi zao za uongozi ndani ya NEC katika kipindi cha siku tisini.
Niliseme hili mapema. Mshangao na mshituko wangu haukusababishwa na kutajwa kwa jina langu, la hasha, bali namna uamuzi halisi wa NEC na hususani dhana nzima ya ‘kujivua gamba’ ilivyoweza kupindishwa na wajanja wachache na kisha kuendeshwa kwa maslahi binafsi ya kikundi fulani cha watu.
Pili, nilishangazwa na kushitushwa na hatua ya viongozi wa chama changu ambacho nimekitumikia kwa bidii na uaminifu mkubwa kufanya juhudi kubwa hata kukivisha kikao kitukufu cha NEC uamuzi ambao msingi wa hoja zake ni vita vya kimakundi ya kisiasa yaliyo ndani ya CCM kwa upande mmoja na propaganda za vyama vya siasa vya upinzani na vyombo vya habari kwa upande mwingine.
Tatu, nilishangazwa na kushitushwa na ujasiri ambao umekuwa ukioneshwa na baadhi ya viongozi wetu wapya wa Sekretarieti wanaolitaja jina langu na kulihusisha na kile wanachokiita ufisadi ambao hata ukweli wa kimazingira na kihistoria ukiachilia mbali ushahidi wa wazi umeshathibitisha kwamba ni porojo za kisiasa zilizotokana na makovu na matarajio ya Uchaguzi Mkuu wa mwaka 2005 na ule ujao wa 2015.
Wazee wangu, nyinyi ni mashahidi kwamba, mbali ya mimi mwenyewe kujitokeza kupitia vyombo vya habari na kueleza wazi kwamba sijapata kujihusisha katika vitendo vyovyote vya ukiukwaji wa maadili ya uongozi au vya rushwa, hakuna ushahidi wowote uliotolewa unaonihusisha na kashfa yoyote miongoni mwa zile zilizotajwa.
Wazee wangu, ni wazi kwamba kama chama chenye siasa chenye dhamana ya kuwaoongoza Watanzania kutoka katika lindi la ufukara, maradhi, matatizo ya makaazi na mengineyo siku zote tunapaswa kuwa makini katika kuhakikisha kwamba changamoto za kuwaongoza na kuwakomboa wananchi waliotupa dhamana hazitikiswi na mawimbi ya matakwa ya nyakati ama ya vyombo vya habari au wapinzani wetu wa kisiasa walio nje ya CCM.
Ni kwa sababu ya kulitambua hilo na hasa kuyatambua madhara yanayoweza kukipata chama chetu na nchi yetu iwapo tutaendekeza siasa za kupakana matope pasipo na sababu za msingi, kuchafuana kusikokoma na kulipizana kisasi ndiyo maana nimeona nitumie fursa hii kuzungumza nanyi wazee wangu ili kuweka kumbukumbu sahihi.
MAAMUZI YANGU
Wazee wangu, nimetafakari sana na kimsingi nimefikia hatua ya kupima yale ambayo yamekuwa yakisemwa na kuandikwa juu yangu na ambayo kwa mtazamo wangu unaoungwa mkono na wanafamilia yangu, marafiki zangu na washirika wangu wa kibiashara walio ndani na nje ya nchi, naona umefika wakati muafaka wa kuchukua hatua.
Kwa sababu ya kutambua uzito wa hatua ninazokusudia kuzichukua, niliona halitakuwa jambo la hekima hata kidogo iwapo ningefanya hivyo pahala pengine popote bali hapa Igunga mbele ya nyie wazee wangu.
Baada ya kukaa na wanafamilia yangu, marafiki na washirika wangu wa kibiashara niliona halitakuwa jambo la busara hata kidogo kuendelea kuvutana na viongozi wa chama changu na wanachama wenzangu wa CCM katika mambo ambayo yanaweza kumalizwa kwa njia muafaka.
Wazee wangu, sina budi niwaeleze kwamba, mbali ya athari za kisiasa na kifamilia, vita vya ovyo vya kisiasa kama hivi tunavyoviendesha na kuviendeleza ndani ya CCM na ndani ya nchi yetu huwa vina athari kubwa katika ulimwengu wa kibiashara. Athari kama hizo za kibiashara huingia ndani zaidi kuliko vichwa vya habari vya magazeti vinavyolenga kuchafuana, na athari hizo huwa kubwa zaidi kwa mtu kama mimi kwa sababu tofauti na wengine wengi hapa nchini, mimi ni mfanyabiashara wa kimataifa.
Katika ulimwengu wa kibiashara wa leo, vita hivi ambavyo vinaweza kuonekana kuwa ni vidogo tu vyenye malengo ya kuchafuana kisiasa, vinakuwa na athari kubwa katika uhusiano wa kibiashara kuliko hata wale wasioelewa wanavyoweza kukadiria. Ndiyo maana nimeona ni afadhali sasa niwape nafasi wale wanaoendesha siasa hizi uchwara na zisizo na tija waendelee na siasa zao hizo ambazo kwa bahati mbaya kwao, mimi sina muda nazo na siwezi kuwa sehemu yake. Na mimi kwa upande wangu niendelee na maisha yangu.
Kutokana na ukweli huo na sababu zote hizo basi, kwa moyo wa dhati na kwa nia thabiti, hatua ya kwanza niliyoiona kuwa ninapaswa kuichukua ilikuwa ni hii ya kuitikia wito unaotokana na msukumo wa ndani ya nafsi yangu wa kuamua kukomesha kabisa malumbano na mivutano isiyo na manufaa kwangu binafsi, kwa viongozi wa chama changu na chama chenyewe.
Msukumo huo si mwingine bali ni ule wa kuamua kuachia nafasi zangu zote za uongozi ndani ya chama, nikianzia na ile ya ujumbe wa Halmashauri Kuu ya Taifa nikiuwakilisha Mkoa wa Tabora na hii ya ubunge wa Igunga ambazo kama si kwa baraka za chama changu nisingelikuwa nazo.
Napenda kuliweka hili sawa sawa. Uamuzi wangu wa kuachia nafasi zangu zote za uongozi nilizopata kwa tiketi ya CCM haukutokana na wala haumaanishi kukubaliana na shinikizo lililopotoshwa kuhusu azma ya utekelezaji wa dhana ya kujivua gamba, la hasha, bali dhamira ya dhati ya kuachana na siasa hizi uchwara (gutter politics) na kutumia muda wangu kushughulika na biashara zangu.
Aidha, nimefikia uamuzi huo lengo likiwa ni kuwajengea heshima na imani machoni mwa wanachama na wananchi wengine, viongozi wangu ambao naamini baada ya mimi kujitoa watapata fursa ya kutafakari upya changamoto nyingine mbadala zinazowakabili ambazo msingi wake ni dhamana kubwa walizo nazo za kukiongoza chama chetu na nchi yetu kupitia Serikali yake.
Wakati nachukua uamuzi huu, natambua vyema kwamba, watatokea watu ndani ya chama chetu na nje ambao watafanya kila juhudi kupotosha au kupindisha ukweli kuhusu hatima yangu ya kisiasa baada ya kujiweka kando na kujipa mimi mwenyewe na chama changu fursa ya kutafakari kwa kina majaaliwa yangu na ya nchi yangu katika siku zijazo.
Nafanya hivyo nikiwa na imani thabiti kwamba, uamuzi wangu huu, hususani ule wa kuachia nafasi yangu ya ubunge, yatakipa fursa nyingine CCM ya kuendelea kuliongoza jimbo letu la Igunga katika kipindi cha miaka minne ijayo kabla ya Uchaguzi Mkuu wa mwaka 2015.
Kwa upande mwingine, uamuzi wangu huu naona ni fursa kwa viongozi wa Chama changu cha CCM kutafakari na kuamua njia wanayoiona wao ni sahihi kuichukua kwa hatima na mustakabali wa chama chetu na ambayo wanaamini itakipa nguvu mpya ya kisiasa dhidi ya vyama vya upinzani.
Sambamba na hilo, ninayo imani thabiti kwamba, uamuzi wangu wa kubakia kuwa mwanachama wa kawaida na mtiifu wa CCM utakuwa chachu kwa chama changu na kwa Serikali yake kuwatumikia wananchi kwa Ari Zaidi, Kasi Zaidi na Nguvu Zaidi.
Mwisho kabisa, nikimalizia naomba nitumie fursa hii kutoa heshima za pekee kwa Rais Jakaya Kikwete kwa kazi kubwa aliyoifanyia na anayoendelea kuifanyia nchi yetu. Amefanya mengi na makubwa kuiendeleza nchi yetu na watu wake kuliko inavyothaminiwa na kufahamika. Kazi yake kubwa inashindwa kuthaminiwa na kufahamika kutokana na siasa chafu tunazoziendesha Tanzania. Wasia wangu kwa wanasiasa wenzangu, waandishi wa habari na Watanzania wenzangu kwa ujumla ni kuwa tunahitaji kuisaidia nchi yetu kwa kufanya siasa zenye mwelekeo wa kujenga ambazo ndiyo hasa zinapaswa kuwa siasa kwa maana halisi ya neno hilo.

The World Heritage Centre (WHC) committee has permitted Tanzania to start exploring uranium in Selous Game Reserve, after the country has met two referral conditions she had been required earlier to fulfill.
According to Minister for Natural Resources and Tourism Ezekiel Maige, the government had been required to work on the two conditions within a period of one year to allow a report to be submitted in the 36th WHC conference.
Making the revelation on the WHC decision reached in France late last month to journalists in Dar es Salaam yesterday, the minister said Tanzania had first been asked to conduct Environmental and Social Impact Assessment (ESIA) indicating possible effects that might occur and work out strategies to minimise their impacts.
In the second condition a United Nations Educational, Scientific and Cultural Organization (Unesco) team was required to visit the project site and work together with government officials in preparing a mining plan and strategies to minimise environmental impacts.
The first condition ESIA submitted to the centre was incomplete because it was not approved by the National Environment Management Council (NEMC) and it showed that it could take long time to discover some of the effects and might not be easy to know their magnitudes.
“Under the permit, other activities relating to commencement of mining can continue while the two conditions were being worked on and submitted to the 36th WHC conference,” the minister.
During the conference, the government took the opportunity to endorse the 1972 International Agreement on Biodiversity Conservation and Protection.
Under the agreement, the minister said, areas that have unique heritage will be recognised and listed in World Heritage Sites under Unesco. According to the agreement, exploration projects are not allowed in the game reserve, he added.
However, given the importance of uranium mining to Tanzania, the government submitted a requested to have the boundaries of Selous Game Reserve changed, and have its 34,532 ha reduced to pave way for the project, he said.
“The centre gave us conditions although Tanzania is our land because of the agreement the government signed which prohibits exploration activities at WHS. The project however is important for the community and government because 78 per cent of the mineral products will remain in the country and create employment,” he said.
Commenting on national conservation in the country, he said WHC received the country report but was somewhat pessimistic about conservation of Serengeti National Park (senapa)—specifically on the proposed road project.
At the meeting, the government explained its stance that the Serengeti road project will not be constructed at tarmac level, (the tarmac will end at Loliondo on the eastern side, leaving 123 kilometers which will be under Tanzania National Parks (Tanapa), he said.
On Wednesday Tanzania and Uganda signed a multi-billion-shilling railway construction project to run from Tanga via Arusha to Musoma which authorities said would steer clear of the much contested Serengeti National Park stretch by 100 kilometers to preserve the ecosystem.
According to Transport minister Omar Nundu, the project will consider concerns by Tanzanians and the international community over the need to preserve Serengeti National Park’s ecosystem.
The plan to steer clear of the particular stretch follows reports by the international media that the government has dropped plans to build a highway through the world-famous park.
The reports also suggest that the government has informed Unesco’s World Heritage Committee that it would continue with its plans to build the proposed Arusha-Musoma highway but without touching the 53km stretch through the National Park.

THE number of Tanzanians in various UN institutions is set to increase this year following endorsement by the African Union (AU) Council of Ministers of two candidates earlier this week.
The candidates are Mr Ludovick Utouh who is the Controller and Auditor General (CAG) and Prof Chris Peter Maina, a dean of the University of Dar es Salaam School of Law. The two, together with other aspirants from the rest of the world will be subject for further endorsement by the UN in September.
But President Jakaya Kikwete said here on Thursday night that he is optimistic that the Tanzanian candidates will be elected for the positions.
"We have the support of Africa and some other countries outside the continent. Therefore there is no doubt we will get the posts," he said.
Mr Utouh is seeking membership in the UN Audit Board while Prof Maina wants to join the International Law Committee (ILC).
The Minister for Foreign Affairs and International Co-operation, Mr Bernard Membe, has said that the names were approved by the AU Council of Ministers on Wednesday.
"They are the sole candidates vying for those posts. We are therefore affirmative that they will sail through," said Mr Membe when briefing journalists on the outcome of the Foreign Ministers meeting.
Mr Utouh and Prof Maina's election will be held during the UN General Assembly scheduled for September in New York. Mr Membe said if elected as expected, the CAG will serve in the board for six years (2012-2018).
The minister further said that Tanzania has also been appointed member of the International Atomic Energy Agency (IAEA).

Man robs bank to get medical care in jail

Some people who need medical care but can't afford it go to the emergency room. Others just hope they'll get better. James Richard Verone robbed a bank.
Earlier this month, Verone (pictured), a 59-year-old convenience store clerk, walked into a Gaston, N.C., bank and handed the cashier a note demanding $1 and medical attention. Then he waited calmly for police to show up.
He's now in jail and has an appointment with a doctor this week.
Verone's problems started when he lost the job he'd held for 17 years as a Coca Cola deliveryman, amid the economic downturn. He found new work driving a truck, but it didn't last. Eventually, he took a part-time position at the convenience store.
But Verone's body wasn't up to it. The bending and lifting made his back ache. He had problems with his left foot, making him limp. He also suffered from carpal tunnel syndrome and arthritis.
Then he noticed a protrusion on his chest. "The pain was beyond the tolerance that I could accept," Verone told the Gaston Gazette. "I kind of hit a brick wall with everything."
Verone knew he needed help--and he didn't want to be a burden on his sister and brothers. He applied for food stamps, but they weren't enough either.
So he hatched a plan. On June 9, he woke up, showered, ironed his shirt. He mailed a letter to the Gazette, listing the return address as the Gaston County Jail.
"When you receive this a bank robbery will have been committed by me," Verone wrote in the letter. "This robbery is being committed by me for one dollar. I am of sound mind but not so much sound body."
Then Verone hailed a cab to take him to the RBC Bank. Inside, he handed the teller his $1 robbery demand.
"I didn't have any fears," said Verone. "I told the teller that I would sit over here and wait for police."
The teller was so frightened that she had to be taken to the hospital to be checked out. Verone, meanwhile, was taken to jail, just as he'd planned it.
Because he only asked for $1, Verone was charged with larceny, not bank robbery. But he said that if his punishment isn't severe enough, he plans to tell the judge that he'll do it again. His $100,000 bond has been reduced to $2,000, but he says he doesn't plan to pay it.
In jail, Verone said he skips dinner to avoid too much contact with the other inmates. He's already seen some nurses and is scheduled to see a doctor on Friday. He said he's hoping to receive back and foot surgery, and get the protrusion on his chest treated. Then he plans to spend a few years in jail, before getting out in time to collect Social Security and move to the beach.
Verone also presented the view that if the United States had a health-care system which offered people more government support, he wouldn't have had to make the choice he did.
"If you don't have your health you don't have anything," Verone said.
The Affordable Care Act, President Obama's health-care overhaul passed by Congress last year, was designed to make it easier for Americans in situations like Verone's to get health insurance. But most of its provisions don't go into effect until 2014.
As it is, Verone said he thinks he chose the best of a bunch of bad options. "I picked jail."

Then Verone hailed a cab to take him to the RBC Bank. Inside, he handed the teller his $1 robbery demand.
"I didn't have any fears," said Verone. "I told the teller that I would sit over here and wait for police."
The teller was so frightened that she had to be taken to the hospital to be checked out. Verone, meanwhile, was taken to jail, just as he'd planned it.
Because he only asked for $1, Verone was charged with larceny, not bank robbery. But he said that if his punishment isn't severe enough, he plans to tell the judge that he'll do it again. His $100,000 bond has been reduced to $2,000, but he says he doesn't plan to pay it.
In jail, Verone said he skips dinner to avoid too much contact with the other inmates. He's already seen some nurses and is scheduled to see a doctor on Friday. He said he's hoping to receive back and foot surgery, and get the protrusion on his chest treated. Then he plans to spend a few years in jail, before getting out in time to collect Social Security and move to the beach.
Verone also presented the view that if the United States had a health-care system which offered people more government support, he wouldn't have had to make the choice he did.
"If you don't have your health you don't have anything," Verone said.
The Affordable Care Act, President Obama's health-care overhaul passed by Congress last year, was designed to make it easier for Americans in situations like Verone's to get health insurance. But most of its provisions don't go into effect until 2014.
As it is, Verone said he thinks he chose the best of a bunch of bad options. "I picked jail."

VURUGU kubwa zilizuka juzi kwenye kituo cha Polisi Babati Mjini mkoani Manyara baada ya wafanyakazi wa kampuni inayojenga barabara ya Chico, raia wa China kumpiga mkuu wa kituo hicho, ASP Shaaban Minginye na mkuu wa polisi jamii mkoani humo, ASP Morris Okinda.
Tukio hilo lililodumu kwa saa mbili kati ya saa 12:30 jioni hadi saa 2:30 usiku liliwalazimisha polisi kutumia mabomu ya machozi na risasi za moto zilizorushwa hewani ambazo hata hivyo zilijibiwa na Wachina hao wakitumiia bastola nao, hali iliyoweka rehani amani mjini Babati.
Wachina hao wanadaiwa kufanya vurugu hizo na kuwashambulia ASP Mingiye na Okinda kwa madai kuwa polisi walimwachia dereva wa basi la abiria aliyelikwaruza gari lao na kusababisha ajali.
Kitendo hicho cha kuwapiga makonde viongozi hao wa polisi mkoani humo kiliamsha hasira za wananchi ambao walianza kumshambulia mmoja wa raia hao wa China.
Mwananchi ilishuhudia raia huyo wa China, Chang Charles akipigwa na wananchi hao waliochukizwa na kitendo chao cha kuwapiga polisi ambapo alijaribu kutumia mtindo wa kujihami 'kung fu' huku akitoa sauti za, 'huu, haa', lakini alipigwa ngumi iliyomjeruhi usoni
Katika tukio hilo, ASP Minginye alipigwa vibao na ngumi na raia mmoja wa China ambapo raia watatu wa China walijeruhiwa vibaya na wananchi na kulazwa kwenye Hospitali ya Mrara mjini Babati na hali zao zilielezwa kuendelea vizuri.
Kamanda wa Polisi wa Mkoa wa Manyara, Liberatus Sabas alithibitisha jana kutokea kwa tukio hilo na kwamba raia 10 wa China wanashikiliwa kwa kuhusika na vurugu hizo.
Alisema chanzo cha vurugu hizo ni raia mmoja wa China, (Chang Charles) kumpiga mkuu wa kituo cha polisi Babati, baada ya kuliachia basi la abiria lililogonga lori linalomilikiwa na kampuni hiyo (Chico), kitendo kilichofanya wananchi kumpiga Mchina huyo.
"Hali hiyo ilijitokeza baada ya basi la abiria aina ya Scania, mali ya Kampuni ya NBS lililokuwa likitokea Kahama kwenda Arusha kukwaruzana na gari la kampuni hiyo ya Kichina lililokuwa linatumika katika ujenzi wa barabara ya Babati-Singida,"alisema.
Alisema baada dereva wa basi hilo kulikwaruza gari la kampuni ya Chico aina ya Ford, tukio hilo liliripotiwa kituo cha polisi Babati na dereva wa basi kutakiwa kuwapeleka abiria Arusha ili kesho yake arudi kituoni hapo.
“Baada ya dereva wa basi kuruhusiwa na kuondoka raia mmoja wa China alianza kurusha mawe kwenye basi hilo na kuvunja taa na kioo cha mbele na kumpiga mkuu wa kituo, ndipo abiria waliposhuka na kuanza kumshambulia Mchina huyo,” alisema Kamanda Sabas.
Alisema baada ya vurugu hizo lilizuka kundi lingine la raia wa China lilijitokeza na kuanza mapambano na wananchi na ndipo katika vurugu hizo askari polisi wakapiga risasi hewani na mabomu ya machozi ili kuwatawanya na kujaribu kusitisha vurugu hizo.
“Hadi hivi sasa Jeshi la Polisi linawashikilia raia 10 wa China wanaodaiwa kuhusika na tukio hilo na tunatarajia kuwafikisha mahakamani leo (jana), ili wakajibu mashtaka ya uaribifu wa mali na kufanya vurugu,” alisema Kamanda Sabas.
Kamanda Sabas aliwataja Wachina hao wanaoshikiliwa na polisi kuwa ni Chang Charles, Luan Hiten(23), Wang Sheng(23), Sing Yun(24), Sing Jin (23), Lin Jun (37), Whang Puong(23) Lu Gang (23) na Sio Jing (23).
Alisema katika vurugu hizo, askari polisi mmoja ambaye hakumtaja jina alijeruhiwa jichoni na Wachina hao na raia watatu wa China walijeruhiwa na kulazwa Hospitali ya Mrara wakipatiwa matibabu.
Aliwataja raia hao wa China waliojeruhiwa kuwa ni Young Gris, Luan Hiten na Chang Charles ambao alisema hali zao zinaendelea vizuri, baada ya kupatiwa matibabu.

HOJA ya kutaka kufutwa kwa posho za vikao za wabunge na watumishi wengine wa umma wa imechukua sura mpya baada ya jana Mbunge wa Bumbuli (CCM), Januari Makamba kuliambia Bunge mjini hapa kuwa suala la kufutwa kwa posho ni la kitaifa na ni sehemu ya Mpango wa Maendeleo wa miaka mitano uliowasilishwa na serikali.
Kauli hiyo yab Makamba ambaye pia ni Katibu wa Mambo ya Nje wa Sekretarieti ya CCM imekuja huku kukiwa na malumbano makali baina ya Spika wa Bunge, Anne Makinda na Mbunge wa Kigoma Kaskazini (Chadema), Zitto Kabwe kuhusu suala hilo la posho za vikao vya wabunge.
Juzi, Spika Makinda alisema Zitto ambaye ni Naibu Kiongozi wa Upinzani Bungeni, anaweza kufukuzwa ubunge kwa kutosaini karatasi za mahudhurio, hatua ambayo Zitto alisema ataichukua ili asilipwe posho za vikao.
Spika alisema Zitto anaweza kukumbwa na adhabu hiyo iwapo hatasaini karatasi za mahudhurio ambazo ndizo zinathibitsha uwepo wa mbunge katika mikutano na vikao vya bunge na kwamba kanuni zinamwadhibu mbunge kwa kumfukuza asipohudhuria mikutano mitatu. Hata hivyo, Zitto amepuuza kauli hiyo ya Spika kwa kusema kwamba kama ni kwa ajili ya kukataa posho, yuko tayari kufukuzwa bungeni.
"Nitafanya hivyo tuone, Kanuni inasema mikutano mitatu mfululizo na siyo vikao vitatu mfululizo. Nitatumia uzoefu wangu wa siasa za wanafunzi kukwepa mtego wake. Lakini kama anadhani ni sawa kunifukuza ubunge kwa kukataa posho, nipo tayari," alisema.
Kauli ya jana ya Makamba pia inaonekana kutofautina na mawazo ya wabunge wengi wa CCM akiwamo Waziri wa Fedha na Uchumi, Mustafa Mkulo ambaye amesema wanashabikia suala hilo wanajitafutia umaarufu.
Akichangia huo wa maendeleo wa miaka mitano jana, Makamba alionekana kupigia chapuo suala la kufutwa au kuangaliwa upya kwa posho za vikao huku akisema kwamba ni la kitaifa na ni sehemu ya mpango huo.
Makamba alisema kuwa suala la nidhamu na usimamizi wa matumizi ya fedha za umma ni muhimu na kwamba mpango huo umeliona katika ukurasa wa 17 wa kitabu kilichochapishwa kwa Kiingereza na kutoa mapendekezo ya kufutwa kwa posho za vikao na zile za usafiri.
"Mpango unabainisha kwamba kuna umuhimu wa kufutwa kwa posho za vikao na usafiri hivyo iwapo wabunge mtalisikia likiwasilishwa hapa kwa mbwembwe kesho (leo), basi msije mkashangaa kwani ni sehemu ya mpango huu," alisema Makamba.
Kujadiliwa bungeni leo
Mjadala kuhusu malipo ya posho ambao umekuwa ukiendelea kwa wiki moja sasa hasa zaidi nje ya Bunge, leo unatarajiwa kuingizwa rasmi bungeni wakati Bajeti ya Serikali iliyowasilishwa na Mkulo Jumatano iliyopita itakapoanza kujadiliwa.
Suala hilo ni dhahiri litajitokeza katika bajeti mbadala itakayowasilishwa na kambi ya Upinzani Bungeni na Waziri Kivuli wa Fedha, Zitto Kabwe ambaye amekuwa katika mvutano usio rasmi na Spika kutokana na kukataa kulipwa posho za kikao.
Mwenyekiti wa Chadema ambaye pia ni Kiongozi wa Upinzani Bungeni, Freeman Mbowe alisema jana kuwa kambi yake inatarajiwa kutoa ushauri mgumu ambao haujazoeleka kwa watendaji wa serikali na kwamba suala la kufutwa kwa posho ni sehemu ya mapendekezo hayo.
Alisema kufutwa kwa posho hizo kunaweza kuokoa zaidi ya Sh900 bilioni ambazo zinaweza kuelekezwa katika maeneo mengine ya huduma kwa wananchi.
Uhalisia posho za wabunge
Mmoja wa wabunge wa CCM ambaye hakutaka kutaandikwa jina lake alisema anasikia kuhukumiwa katika nafsi yake kutokana na kupokea posho za vikao ambazo kimsingi ni sawa na "kuwaibia wananchi".
"Ujue bwana sisi ndani ya CCM mambo hayaendi kama kwa wenzetu (Chadema), wale wanaweza kukaa leo na kuamua, sisi ni tofauti lazima kuwepo na mchakato lakini ukweli ni kwamba hoja yao ni nzuri," alisema mbunge huyo.
Uchunguzi uliofanywa umebaini kuwa malipo ya wabunge yamegawanyika katika sehemu nne ambazo ni pamoja na mshahara ambao ni Sh2,300,000 kwa mwezi, posho ya ubunge kila mwezi ambayo ni Sh5 milioni, posho ya kujikimu (per-diem) Sh80,000 wawapo nje ya majimbo yao kikazi na posho ya vikao (sitting allowance) ambayo huwa ni Sh70,000 kwa kila mbunge.
Kwa maana hiyo, kwa kawaida mbunge hulipwa Sh7.3 milioni kila mwezi kabla ya kukatwa kodi na wawapo Dodoma na Dar es Salaam kwa ajili ya vikao vya kamati na bunge au mikoani kwa ajili ya kukagua shughuli zilizopo chini ya kamati zao. Hulipwa kiasi cha Sh150,000 kila mmoja kwa siku ambazo ni Sh70,000 kwa ajili ya vikao na Sh80,000 kwa ajili ya kujikimu.
Kwa maana hiyo bunge linatarajiwa kutumia kiasi cha Sh1.788 bilioni kwa ajili ya kugharamia vikao 73 vya Bunge la Bajeti iwapo wabunge wote 350 waliopo watahudhuria vikao hivyo.
Kwa hesabu hizo, kila mbunge katika mkutano wa Bunge la Bajeti anatarajiwa kuondoka na kikita cha Sh5.1 milioni mbali na Sh 5.58 milioni ambazo ni malipo kwa ajili ya kujikimu, fedha ambazo ni mbali na mshahara wake kwa mwezi na posho ya ubunge.
CCM yakataa posho
Chama Cha Mapinduzi (CCM), kimeanza machakato wa kufuta posho hizo ikiwa ni hatua ya kupunguza matumizi yasiyo ya lazima. Habari kutoka ndani ya CCM, Dodoma na Dar es Salaam zinasema kuwa mkakati wa kufutwa kwa posho ulianzishwa takriban mwezi mmoja uliopita na sekretarieti mpya inayoongozwa na Katibu Mkuu, Wilson Mukama.
Kwa mujibu wa taarifa hizo, baadhi ya wajumbe wa sekretarieti walihoji uhalali wa posho wanazolipwa hata pale vikao vinapofanyika katika sehemu ambako ni makazi yao na kwamba hoja hizo ndizo zilizozaa wazo la kufutwa kwa posho katika vikao.
"Hoja ilikuwa kwamba kama chama hakina fedha na tunataka kupunguza matumizi yasiyo ya lazima, basi posho za vikao zifutwe kwa sababu hakuna ulazima wa posho hizo hasa kwa wajumbe wa sekretarieti ambao kazi zao ni za kila siku," kilieleza chanzo chetu na kuongeza:
"Hivi sasa mpango huo uko kwenye mchakato wa kuwekewa mwongozo na nadhani baada ya kupitia katika vikao vyetu utaanza kutekelezwa. Lakini kimsingi ni kama utekelezaji wake umeshaanza kwa sababu baadhi ya wajunbe wamekataa kabisa kusaini posho hizo."
Habari zaidi zinadai kuwa waraka wa mapendekezo ya kupunguza matumizi ndani ya CCM unakwenda mbali zaidi hadi katika matumizi ya magari na kwamba pale usafiri unapohitaji wa kuelekea kwenye mkutano mmoja, basi viongozi watumie magari machache kwa maana ya usafiri wa pamoja badala ya utaratibu wa sasa ambao unamruhusu kila kiongozi kutumia usafiri wake.
Katibu wa Itikadi na Uenezi wa CCM, Nape Nnauye alipoulizwa kuhusu sekretarieti kufuta posho katika vikao vyake, hakukanusha wala kuthibitisha, badala yake akadai kuwa hayo ni mambo ya ndani ya chama ambayo hayana faida yoyote kwa umma.
"Hivi ninyi waandishi wa habari, haya mambo mnayapata kwa nani! Haya ni mambo ya ndani ya chama sidhani kama yana tija yoyote kwa umma, maana haiwezi kusaidia chochote," alisema Nape kwa kwa simu.
Alipoelezwa kwamba suala hilo lina uhusiano na sakata linaloendelea bungeni, Nape alisema: "Bunge ni bunge na chama ni chama. Kila taasisi inajitegemea na ina uamuzi wake, lakini pia sisi kama chama tulishatoa kauli mara nyingi kwamba suala la posho kwa wabunge na watumishi wengine wa serikali linazungumzika, ni la kisera na wanaohusika wapo waulizeni hao."
Mwishoni mwa wiki iliyopita Nape akizungumzia malumbano miongoni mwa wabunge kuhusu suala la posho alisema suala hilo linajadilika na kwamba si vyema kulipinga kwa sababu tu linatokea kambi ya upinzani.
Kwa upande wake, Makamba alipulizwa kuhusu kufutwa kwa posho katika vikao vya Sekretarieti ya CCM naye kama ilivyokuwa kwa Nape, hakukanusha wala kuthibitisha.
"Wewe si unamfahamu msemaji wa chama ni nani? Mwulizeni Nape tena nadhani anakuja Dodoma. Akija mwulizeni, mimi siwezi kulizungumzia.... lakini ninyi waandishi haya mambo ya ndani ya chama huwa mnayapata wapi? Anyway, mwulizeni mwenezi atawaambia," alisema Makamba.

Mjadala kuhusu malipo ya posho ambao umekuwa ukiendelea kwa wiki moja sasa hasa zaidi nje ya Bunge, leo unatarajiwa kuingizwa rasmi bungeni wakati Bajeti ya Serikali iliyowasilishwa na Mkulo Jumatano iliyopita itakapoanza kujadiliwa.
Suala hilo ni dhahiri litajitokeza katika bajeti mbadala itakayowasilishwa na kambi ya Upinzani Bungeni na Waziri Kivuli wa Fedha, Zitto Kabwe ambaye amekuwa katika mvutano usio rasmi na Spika kutokana na kukataa kulipwa posho za kikao.
Mwenyekiti wa Chadema ambaye pia ni Kiongozi wa Upinzani Bungeni, Freeman Mbowe alisema jana kuwa kambi yake inatarajiwa kutoa ushauri mgumu ambao haujazoeleka kwa watendaji wa serikali na kwamba suala la kufutwa kwa posho ni sehemu ya mapendekezo hayo.
Alisema kufutwa kwa posho hizo kunaweza kuokoa zaidi ya Sh900 bilioni ambazo zinaweza kuelekezwa katika maeneo mengine ya huduma kwa wananchi.
Uhalisia posho za wabunge
Mmoja wa wabunge wa CCM ambaye hakutaka kutaandikwa jina lake alisema anasikia kuhukumiwa katika nafsi yake kutokana na kupokea posho za vikao ambazo kimsingi ni sawa na "kuwaibia wananchi".
"Ujue bwana sisi ndani ya CCM mambo hayaendi kama kwa wenzetu (Chadema), wale wanaweza kukaa leo na kuamua, sisi ni tofauti lazima kuwepo na mchakato lakini ukweli ni kwamba hoja yao ni nzuri," alisema mbunge huyo.
Uchunguzi uliofanywa umebaini kuwa malipo ya wabunge yamegawanyika katika sehemu nne ambazo ni pamoja na mshahara ambao ni Sh2,300,000 kwa mwezi, posho ya ubunge kila mwezi ambayo ni Sh5 milioni, posho ya kujikimu (per-diem) Sh80,000 wawapo nje ya majimbo yao kikazi na posho ya vikao (sitting allowance) ambayo huwa ni Sh70,000 kwa kila mbunge.
Kwa maana hiyo, kwa kawaida mbunge hulipwa Sh7.3 milioni kila mwezi kabla ya kukatwa kodi na wawapo Dodoma na Dar es Salaam kwa ajili ya vikao vya kamati na bunge au mikoani kwa ajili ya kukagua shughuli zilizopo chini ya kamati zao. Hulipwa kiasi cha Sh150,000 kila mmoja kwa siku ambazo ni Sh70,000 kwa ajili ya vikao na Sh80,000 kwa ajili ya kujikimu.
Kwa maana hiyo bunge linatarajiwa kutumia kiasi cha Sh1.788 bilioni kwa ajili ya kugharamia vikao 73 vya Bunge la Bajeti iwapo wabunge wote 350 waliopo watahudhuria vikao hivyo.
Kwa hesabu hizo, kila mbunge katika mkutano wa Bunge la Bajeti anatarajiwa kuondoka na kikita cha Sh5.1 milioni mbali na Sh 5.58 milioni ambazo ni malipo kwa ajili ya kujikimu, fedha ambazo ni mbali na mshahara wake kwa mwezi na posho ya ubunge.
CCM yakataa posho
Chama Cha Mapinduzi (CCM), kimeanza machakato wa kufuta posho hizo ikiwa ni hatua ya kupunguza matumizi yasiyo ya lazima. Habari kutoka ndani ya CCM, Dodoma na Dar es Salaam zinasema kuwa mkakati wa kufutwa kwa posho ulianzishwa takriban mwezi mmoja uliopita na sekretarieti mpya inayoongozwa na Katibu Mkuu, Wilson Mukama.
Kwa mujibu wa taarifa hizo, baadhi ya wajumbe wa sekretarieti walihoji uhalali wa posho wanazolipwa hata pale vikao vinapofanyika katika sehemu ambako ni makazi yao na kwamba hoja hizo ndizo zilizozaa wazo la kufutwa kwa posho katika vikao.
"Hoja ilikuwa kwamba kama chama hakina fedha na tunataka kupunguza matumizi yasiyo ya lazima, basi posho za vikao zifutwe kwa sababu hakuna ulazima wa posho hizo hasa kwa wajumbe wa sekretarieti ambao kazi zao ni za kila siku," kilieleza chanzo chetu na kuongeza:
"Hivi sasa mpango huo uko kwenye mchakato wa kuwekewa mwongozo na nadhani baada ya kupitia katika vikao vyetu utaanza kutekelezwa. Lakini kimsingi ni kama utekelezaji wake umeshaanza kwa sababu baadhi ya wajunbe wamekataa kabisa kusaini posho hizo."
Habari zaidi zinadai kuwa waraka wa mapendekezo ya kupunguza matumizi ndani ya CCM unakwenda mbali zaidi hadi katika matumizi ya magari na kwamba pale usafiri unapohitaji wa kuelekea kwenye mkutano mmoja, basi viongozi watumie magari machache kwa maana ya usafiri wa pamoja badala ya utaratibu wa sasa ambao unamruhusu kila kiongozi kutumia usafiri wake.
Katibu wa Itikadi na Uenezi wa CCM, Nape Nnauye alipoulizwa kuhusu sekretarieti kufuta posho katika vikao vyake, hakukanusha wala kuthibitisha, badala yake akadai kuwa hayo ni mambo ya ndani ya chama ambayo hayana faida yoyote kwa umma.
"Hivi ninyi waandishi wa habari, haya mambo mnayapata kwa nani! Haya ni mambo ya ndani ya chama sidhani kama yana tija yoyote kwa umma, maana haiwezi kusaidia chochote," alisema Nape kwa kwa simu.
Alipoelezwa kwamba suala hilo lina uhusiano na sakata linaloendelea bungeni, Nape alisema: "Bunge ni bunge na chama ni chama. Kila taasisi inajitegemea na ina uamuzi wake, lakini pia sisi kama chama tulishatoa kauli mara nyingi kwamba suala la posho kwa wabunge na watumishi wengine wa serikali linazungumzika, ni la kisera na wanaohusika wapo waulizeni hao."
Mwishoni mwa wiki iliyopita Nape akizungumzia malumbano miongoni mwa wabunge kuhusu suala la posho alisema suala hilo linajadilika na kwamba si vyema kulipinga kwa sababu tu linatokea kambi ya upinzani.
Kwa upande wake, Makamba alipulizwa kuhusu kufutwa kwa posho katika vikao vya Sekretarieti ya CCM naye kama ilivyokuwa kwa Nape, hakukanusha wala kuthibitisha.
"Wewe si unamfahamu msemaji wa chama ni nani? Mwulizeni Nape tena nadhani anakuja Dodoma. Akija mwulizeni, mimi siwezi kulizungumzia.... lakini ninyi waandishi haya mambo ya ndani ya chama huwa mnayapata wapi? Anyway, mwulizeni mwenezi atawaambia," alisema Makamba.

HOJA ya kutaka kufutwa kwa posho za vikao za wabunge na watumishi wengine wa umma wa imechukua sura mpya baada ya jana Mbunge wa Bumbuli (CCM), Januari Makamba kuliambia Bunge mjini hapa kuwa suala la kufutwa kwa posho ni la kitaifa na ni sehemu ya Mpango wa Maendeleo wa miaka mitano uliowasilishwa na serikali.
Kauli hiyo yab Makamba ambaye pia ni Katibu wa Mambo ya Nje wa Sekretarieti ya CCM imekuja huku kukiwa na malumbano makali baina ya Spika wa Bunge, Anne Makinda na Mbunge wa Kigoma Kaskazini (Chadema), Zitto Kabwe kuhusu suala hilo la posho za vikao vya wabunge.
Juzi, Spika Makinda alisema Zitto ambaye ni Naibu Kiongozi wa Upinzani Bungeni, anaweza kufukuzwa ubunge kwa kutosaini karatasi za mahudhurio, hatua ambayo Zitto alisema ataichukua ili asilipwe posho za vikao.
Spika alisema Zitto anaweza kukumbwa na adhabu hiyo iwapo hatasaini karatasi za mahudhurio ambazo ndizo zinathibitsha uwepo wa mbunge katika mikutano na vikao vya bunge na kwamba kanuni zinamwadhibu mbunge kwa kumfukuza asipohudhuria mikutano mitatu. Hata hivyo, Zitto amepuuza kauli hiyo ya Spika kwa kusema kwamba kama ni kwa ajili ya kukataa posho, yuko tayari kufukuzwa bungeni.
"Nitafanya hivyo tuone, Kanuni inasema mikutano mitatu mfululizo na siyo vikao vitatu mfululizo. Nitatumia uzoefu wangu wa siasa za wanafunzi kukwepa mtego wake. Lakini kama anadhani ni sawa kunifukuza ubunge kwa kukataa posho, nipo tayari," alisema.
Kauli ya jana ya Makamba pia inaonekana kutofautina na mawazo ya wabunge wengi wa CCM akiwamo Waziri wa Fedha na Uchumi, Mustafa Mkulo ambaye amesema wanashabikia suala hilo wanajitafutia umaarufu.
Akichangia huo wa maendeleo wa miaka mitano jana, Makamba alionekana kupigia chapuo suala la kufutwa au kuangaliwa upya kwa posho za vikao huku akisema kwamba ni la kitaifa na ni sehemu ya mpango huo.
Makamba alisema kuwa suala la nidhamu na usimamizi wa matumizi ya fedha za umma ni muhimu na kwamba mpango huo umeliona katika ukurasa wa 17 wa kitabu kilichochapishwa kwa Kiingereza na kutoa mapendekezo ya kufutwa kwa posho za vikao na zile za usafiri.
"Mpango unabainisha kwamba kuna umuhimu wa kufutwa kwa posho za vikao na usafiri hivyo iwapo wabunge mtalisikia likiwasilishwa hapa kwa mbwembwe kesho (leo), basi msije mkashangaa kwani ni sehemu ya mpango huu," alisema Makamba.

Habari zaidi zinadai kuwa waraka wa mapendekezo ya kupunguza matumizi ndani ya CCM unakwenda mbali zaidi hadi katika matumizi ya magari na kwamba pale usafiri unapohitaji wa kuelekea kwenye mkutano mmoja, basi viongozi watumie magari machache kwa maana ya usafiri wa pamoja badala ya utaratibu wa sasa ambao unamruhusu kila kiongozi kutumia usafiri wake.
Katibu wa Itikadi na Uenezi wa CCM, Nape Nnauye alipoulizwa kuhusu sekretarieti kufuta posho katika vikao vyake, hakukanusha wala kuthibitisha, badala yake akadai kuwa hayo ni mambo ya ndani ya chama ambayo hayana faida yoyote kwa umma.
"Hivi ninyi waandishi wa habari, haya mambo mnayapata kwa nani! Haya ni mambo ya ndani ya chama sidhani kama yana tija yoyote kwa umma, maana haiwezi kusaidia chochote," alisema Nape kwa kwa simu.
Alipoelezwa kwamba suala hilo lina uhusiano na sakata linaloendelea bungeni, Nape alisema: "Bunge ni bunge na chama ni chama. Kila taasisi inajitegemea na ina uamuzi wake, lakini pia sisi kama chama tulishatoa kauli mara nyingi kwamba suala la posho kwa wabunge na watumishi wengine wa serikali linazungumzika, ni la kisera na wanaohusika wapo waulizeni hao."
Mwishoni mwa wiki iliyopita Nape akizungumzia malumbano miongoni mwa wabunge kuhusu suala la posho alisema suala hilo linajadilika na kwamba si vyema kulipinga kwa sababu tu linatokea kambi ya upinzani.
Kwa upande wake, Makamba alipulizwa kuhusu kufutwa kwa posho katika vikao vya Sekretarieti ya CCM naye kama ilivyokuwa kwa Nape, hakukanusha wala kuthibitisha.
"Wewe si unamfahamu msemaji wa chama ni nani? Mwulizeni Nape tena nadhani anakuja Dodoma. Akija mwulizeni, mimi siwezi kulizungumzia.... lakini ninyi waandishi haya mambo ya ndani ya chama huwa mnayapata wapi? Anyway, mwulizeni mwenezi atawaambia," alisema Makamba.

As a boom box played kitschy wedding music, Ryan Rutherford and Kati
Weisz held hands and exchanged vows. The ceremony was performed not by
a preacher but a teacher and took place in their classroom.
For five days, they will take on the responsibility of children,
hammer out a household budget, discuss how to juggle work and family
and then grapple with a crisis--either an addiction, an affair or the
death of one partner.
The psychology course with the mock wedding is one of the most
popular electives at Redlands High School and part of a growing
nationwide movement to teach middle school and high school students
about marriage and family to stem the 50 percent divorce rate in the
U.S.
In recent years, hundreds of schools, including some in Illinois, have
introduced curricula dealing with such topics as finding the right
mate, passion, conflict resolution and breaking up. Last year, Florida
introduced a law requiring all students at public and private high
schools to take at least one marriage and family course to graduate.
At the same time, Florida and other states have passed laws offering
reduced marriage license fees and similar incentives to couples who
agree to take marriage classes before heading down the aisle.
Louisiana and Arizona have adopted legislation offering couples
considering a breakup the option of going through intensive counseling
to head off a divorce. And Oklahoma Gov. Frank Keating has announced
plans to launch a $10 million program--consisting of statewide
lectures and high school courses--aimed at cutting the divorce rate by
one-third by 2010.
The programs have been criticized by some who assert the government
has no business meddling in such personal matters and by others who
argue that students would be better served if schools focused on
raising their academic abilities rather than improving their social
skills.
While a growing body of research indicates divorce and the breakdown
of the family are responsible for a number of social ills, some
preliminary studies also suggest that providing students instruction
in building healthy relationships can postpone sexual activity and
reduce youth violence.
"If we can have good families, we'll have stable kids. Home is the
first influence," said Charlene Kamper, who teaches the marriage class
at Redlands High School, about 70 miles east of Los Angeles.
"Academics are very important. But if a person is not in a good
emotional state, academics become secondary," added Kamper, who
developed a curriculum called "Connections: Relationships and
Marriage" used in numerous schools nationwide. "So many kids tell me
this is one of the most useful classes they have taken."
The latest movement goes against efforts of the last three decades to
downplay marriage.
With the sexual revolution, women's rights movement and divorce
reform, marriage had been discounted and even derided by some scholars
and by popular culture, experts observed. Indeed, the image of
marriage changed from the idealism depicted in 1950s television shows
such as "Father Knows Best" and "Leave It to Beaver" to the
dysfunction of such 1980s and '90s sitcoms as "Roseanne" and "Married
With Children."
"It was politically incorrect in some academic circles to
talk positively about marriage," said Diane Sollee, founder and
director of Smart Marriages: Coalition for Marriage, Family and
Couples Education, a Washington-based group of scholars, therapists
and clergy.
"Then we got the statistics on all the kids in jail and all the girls
who were having babies because they had no connection with their
fathers," Sollee said, adding that studies also show that children
from single-parent households are more likely to be sexually abused,
less likely to go to college and more likely to get divorced after
marrying. "What's the best way to keep fathers connected with their
children? Marriage."
Even couples living together fare worse than married couples,
according to some researchers.
"Domestic violence is much higher among cohabitating couples," said
Linda Waite, a psychology professor at the University of Chicago and
co-author of the upcoming book, "The Case for Marriage: Why Married
People Are Healthier, Happier and Better Off Financially."
"The emotional well-being doesn't seem to be as high among
cohabitating couples as married couples," Waite said. "Cohabitating
men seem to be quite uncommitted to the relationship."
The emphasis on marriage instruction, according to experts, started
largely with therapists who recognized that most troubled marriages
were not a result of psychological problems but a lack of marital
skills. As the thinking goes among those at the center of the marriage
instruction movement, breakups can be pre-empted by preparing people
before they get married.
Last year, Florida introduced the Marriage Preparation and
Preservation Act, aimed at "promoting stability and continuity in
society." The law gives couples a $32.50 discount on the $88.50
marriage license fee if they take a four-hour marriage instruction
course, requires divorcing couples with children to attend a parent
"stabilization" course, and makes a marriage and family course a
requirement for high school students.
"Throughout the nation, people want to see the divorce rate come down;
they want information on how to build stronger marriages," said state
Rep. Elaine Bloom, a Florida Democrat who introduced the marriage
instruction law.
But with school finances always an issue, some teachers' groups
question whether schools should be spending time and money focusing on
such non-academic issues and whether government should be involved."I
think there is good in helping students learn about
marriage but I just wonder about government intrusion in your
private life," said David Clark, spokesman for the Florida Education
Association, which represents more than 120,000 teachers.
"Were schools designed to do this much socialization and values
clarification? Many teachers would argue it would be great if they
could focus more on academic subjects and worry less about these
things," Clark added. " . . . There is an argument for offering them
marriage classes as an elective, but saying you must teach
them is a little pushy."
The marriage curricula taught in the schools vary widely.
In the "Connections" program, taught at Redlands High School, the
teacher on one recent day discussed how to identify real love: Does
the person accept me for me? Does the person love me without
expectations for me to do something in return? Will the person allow
me to grow in the future?
Kamper, who teaches the class, offered tips on finding the right mate:
Does the person feel like my best friend? Do I want to spend time with
him/her? Is it impossible to see myself without this person in my
life?
And she talked about the role of sex in a marriage. "Sure it's
exciting. It enhances the relationship. But it is not enough," Kamper
said. "Someone has to go to work, empty the trash and take care of the
bills. You can't spend your life in bed."
Though it will be years before researchers determine whether the
programs will preserve the marriages of these students, they have
found the courses have positive short-term effects.
In a study of the Loving Well program, a nationwide program that uses
literature to illustrate romantic love, bad relationships and happy
marriages, only 8 percent of 8th graders who were virgins opted to
have sex after taking the course compared with 28 percent of a control
group who didn't take the course.
And another study showed that students in the Connections course were
less likely than other teens to use violence to solve conflicts.
"Students in Connections were more likely to use reasoning tactics and
less likely to yell, cuss, put someone down or use violence when in a
conflict," said Scott Gardner, an assistant professor of human
development and family sciences at South Dakota State University, who
conducted the study on the marriage curriculum.
"Connections kids were more likely to go to their parents for help in
a personal situation with their boyfriend or girlfriend," he added.
"We measured their attitude on divorce: Is it OK to divorce if you
have unsolvable differences? The Connections group was less likely to
agree with that."
In Room 443 at Redlands High School, about 10 couples stood in the
aisles and took part in the mock wedding. Some paired up just for the
sake of the class, but others--like Rutherford, 19, and Weisz,
18--were real couples seeking information on how to make their
relationship last.
"My parents divorced when I was in the 2nd grade. I blamed a lot of
things that happened in my life on my parents' divorce," said
Rutherford.
"I came out of the class understanding more about myself
and what to expect when I do get married."

THE Government has started a process of designing a Universal Social Pension scheme (USP) that will enable all Tanzanians aged 60 and above to get a monthly stipend to sustain their living and reduce abject poverty.
The move follows a study conducted by Ministry of Labour and Employment in conjunction with HelpAge International, which revealed that it was possible to provide a USP to all senior citizens in the country at affordable cost.
“Basically the Prime Minister and the President have agreed on this need for universal social protection scheme, and the ground work has started,” said the Assistant Commissioner for Labour (Social Protection) Mr David Kaali during the workshop on Friday in Dar es Salaam.
Mr Kaali said currently discussions are going on within government machinery, which will be followed by stakeholders’ comments, the cabinet and thereafter the bill will be tabled before the parliament.
“I still cannot tell you when it will be tabled but different ministries need to discuss among themselves to see who will be responsible for what when the scheme starts,” he said during the workshop organized by Economic and Social Research Foundation (ESRF).
According to the study, there are around two million people aged 60 in Tanzania and are present in almost one out of four households. Also 82 per cent reside in rural areas.
The HelpAge Country Programme Director, Mr Nicodemus Chipfupa, said that it was important for the government to introduce the USP scheme because older people are less able to earn adequate income through work, are more susceptible to chronic illness, disability and more likely experience social exclusion.
“Formal social security mechanisms have not reached the poor and are unlikely to offer a solution to old age poverty. Only 6.5 per cent of the workforce is currently covered by formal social security,” said Mr Chipfupa.
The study has suggested every older person to be paid up to16,586/- per month, which in total will consume 1.2 per cent of the Gross Domestic Product per annum.
The study which was conducted between November 2009 and April last year also revealed that if the USP will be implemented, it will reduce 58 per cent of the old age poverty (from 33 to 13.9 per cent) and could reduce up to 11.9 per cent of national poverty rate.
It is estimated that Tanzania has a labour force of 16 million, out of which 93.5 per cent are in the informal sector and 6.5 percent are in the formal sector, according to Mr Kaali.
It has been suggested by the study that registration and de-registration of beneficiaries of the new scheme should be implemented through the local government structures.
“Voter cards, village registers, letters issued by village or ward officers could be used to identify older people,” said the report of the study.
According to the HelpAge International Programme Manager (Social Protection) Mr Smart Daniel, Tanzanians could seize the opportunity for a new constitution to ensure that rights and entitlements of older people and other vulnerable people, including social pension are protected and provided timely.

THE REPUBLIC OF TANGANYIKA AND THE PEOPLES' REPUBLIC OF
ZANZIBAR
WHEREAS the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar being mindful of the long association of the peoples of these lands and of their ties of kinship and amity, and being desirous of furthering that association and strengthening of these ties and of furthering the unity of African peoples have met and considered the union of the Republic of Tanganyika with the Peoples Republic of Zanzibar:
AND WHEREAS the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar are desirous that the two Republics shall be united in one Sovereign Republic in accordance with the Articles hereinafter contained:-
It is therefore AGREED between the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar as follows: -
(i) The Republic of Tanganyika and the Peoples' Republic of Zanzibar shall be united in one Sovereign Republic .
(ii) During the period from the commencement of the union until the Constituent Assembly provided for in Article (vii) shall have met and adopted a Constitution for the united Republic (hereinafter referred to as the interim period) the united Republic (iii) to (vi). shall be governed in accordance with the provisions of Articles
(iii) During the interim period the Constitution of the united Republic shall be the Constitution of Tanganyika so modified as to provide for-
(a) a separate legislature and executive in and for Zanzibar from time to time constituted in accordance with the existing law of Zanzibar and having exclusive authority within Zanzibar for matters other than those reserved to the Parliament and Executive of the united Republic;
(b) the offices of two Vice-Presidents one of whom (being. a person normally resident in Zanzibar) shall be the head of the aforesaid executive in and for Zanzibar and shall be the principal assistant of the President of the United Republic in the discharge of his executive functions in relation to Zanzibar;
(c) the representation of Zanzibar in the Parliament of the United Republic ;
(d) such other matters as may be expedient or desirable to give effect to the united Republic and to these Articles.
(iv) There shall reserved to the Parliament and Executive of the united Republic the following matters-
(a) The Constitution and Government of the united Republic.
(b) External Affairs.
(c) Defence.
(d) Police.
(e) Emergency Powers.
(f) Citizenship.
(g) Immigration.
(h) External Trade and Borrowing.
(i) The Public Service of the united Republic.
(j) Income Tax, Corporation Tax, Customs and Excise.
(k) Harbours, Civil Aviation, Posts and Telegraphs.
And the said Parliament and Executive shall have exclusive authority in such matters throughout and for the purposes of the united Republic and in addition exclusive authority in respect of all other matters in and for Tanganyika .
(v) The existing laws of Tanganyika and of Zanzibar shall remain in force in their respective territories subject-
(a) to any provision made hereafter by a competent legislature;
(b) to such provision as may be made by order of the President of the united Republic for the extension to Zanzibar of any law relating to any of the matters set out in Article (iv), and the revocation of any corresponding law of Zanzibar;
(c) to such amendments as may be expedient or desirable to give effect to the union and to these Articles.
(v) (a) The first President of the united Republic shall be Mwalimu Julius K.
Nyerere and he shall carry on the Government of the united Republic in accordance with the provisions of these Articles and with the assistance of the Vice-Presidents aforesaid and of such other ministers and officers as he may appoint from Tanganyika and Zanzibar and their respective public services.
(b) The first Vice-President from Zanzibar to be appointed in accordance with the modifications provided for in Article (iii) shall be Sheikh Abeid Karume.
(vii) The President of the united Republic: in agreement with the Vice-President who is head of the Executive in Zanzibar shall-
(a) Appoint a Commission to make proposals for a Constitution for the
united Republic.
(b) Summon a Constituent Assembly composed of Representatives from Tanganyika and from Zanzibar in such numbers as they may determine to meet within one year of the commencement of the union for the purpose of considering the proposals of the Commission aforesaid and to adopt a Constitution for the united Republic.
(viii) These Articles shall be subject to the enactment of laws by the Parliament of Tanganyika and by the Revolutionary Council of the Peoples' Republic of Zanzibar in conjunction with the Cabinet of Ministers thereof, ratifying the same and providing for the Government of the united Republic and of Zanzibar in accordance therewith.

between
THE REPUBLIC OF TANGANYIKA AND THE PEOPLES' REPUBLIC OF
ZANZIBAR
WHEREAS the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar being mindful of the long association of the peoples of these lands and of their ties of kinship and amity, and being desirous of furthering that association and strengthening of these ties and of furthering the unity of African peoples have met and considered the union of the Republic of Tanganyika with the Peoples Republic of Zanzibar:
AND WHEREAS the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar are desirous that the two Republics shall be united in one Sovereign Republic in accordance with the Articles hereinafter contained:-
It is therefore AGREED between the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar as follows: -
(i) The Republic of Tanganyika and the Peoples' Republic of Zanzibar shall be united in one Sovereign Republic .
(ii) During the period from the commencement of the union until the Constituent Assembly provided for in Article (vii) shall have met and adopted a Constitution for the united Republic (hereinafter referred to as the interim period) the united Republic (iii) to (vi). shall be governed in accordance with the provisions of Articles
(iii) During the interim period the Constitution of the united Republic shall be the Constitution of Tanganyika so modified as to provide for-
(a) a separate legislature and executive in and for Zanzibar from time to time constituted in accordance with the existing law of Zanzibar and having exclusive authority within Zanzibar for matters other than those reserved to the Parliament and Executive of the united Republic;
(b) the offices of two Vice-Presidents one of whom (being. a person normally resident in Zanzibar) shall be the head of the aforesaid executive in and for Zanzibar and shall be the principal assistant of the President of the United Republic in the discharge of his executive functions in relation to Zanzibar;
(c) the representation of Zanzibar in the Parliament of the United Republic ;
(d) such other matters as may be expedient or desirable to give effect to the united Republic and to these Articles.
(iv) There shall reserved to the Parliament and Executive of the united Republic the following matters-
(a) The Constitution and Government of the united Republic.
(b) External Affairs.
(c) Defence.
(d) Police.
(e) Emergency Powers.
(f) Citizenship.
(g) Immigration.
(h) External Trade and Borrowing.
(i) The Public Service of the united Republic.
(j) Income Tax, Corporation Tax, Customs and Excise.
(k) Harbours, Civil Aviation, Posts and Telegraphs.
And the said Parliament and Executive shall have exclusive authority in such matters throughout and for the purposes of the united Republic and in addition exclusive authority in respect of all other matters in and for Tanganyika .
(v) The existing laws of Tanganyika and of Zanzibar shall remain in force in their respective territories subject-
(a) to any provision made hereafter by a competent legislature;
(b) to such provision as may be made by order of the President of the united Republic for the extension to Zanzibar of any law relating to any of the matters set out in Article (iv), and the revocation of any corresponding law of Zanzibar;
(c) to such amendments as may be expedient or desirable to give effect to the union and to these Articles.

FROM A BANK CONVERTED INTO MOBILE PHONE VOUCHERS
A Dar es Salaam-based businessman has been charged with alleged fraud and theft of more than half a billion shillings from a bank, in one of the biggest money laundering cases in the country.
Forty-year-old Humoud Ally Salum, a resident of Kariakoo area in the city, was arraigned before the Kisutu Resident Magistrate's Court on January 17, this year, on 15 counts of fraud, theft and money laundering.
In the elaborate money laundering scam, the businessman was alleged to have stolen hundreds of millions of shillings from one bank, transferred the money to another bank then quickly converted the cash into mobile phone vouchers.
He is alleged to have used the stolen funds to purchase mobile phone vouchers worth more than 500m/- on different occasions to try to hide the source of the illicit money.
The businessman denied the charges before resident magistrate Sundi Fimbo and was sent to remand prison until the case comes up for another mention today.
In the first count, prosecutors alleged that Salum illegally obtained more than 560m/- from CRDB Bank through fraud.
"Humoud Ally Salum ... between November and December 2010 within the city and region of Dar es Salaam, conspired with other persons unknown to defraud CRDB Bank 562,861,500/-," said part of the charge sheet seen by THISDAY.
In the second count, the accused person was charged with theft of the stated amount from CRDB Bank.
Prosecutors charged the businessmen with more than ten counts of money laundering.
According to the charge sheet, Salum "directly engaged himself in a transaction involving the proceeds of a predicate offence by receiving credit in his bank account number 041103001336 at NBC Limited Muhimbili branch amounting to 185,580,000/-, which was stolen from CRDB Bank."
Prosecutors alleged that Salum received another payment of 228,375,000/- in the same NBC bank account on December 7, last year, which was allegedly stolen from NBC Bank.
On December 20, last year, another payment of 148,906,500/- was allegedly made into his NBC bank account from the same stolen CRDB bank funds, prosecutors said.
Salum, who is also known as Salim or Humoud Shkely, is alleged to have used 73m/- out of the stolen funds to purchase mobile phone recharge vouchers from Shivacom Group in Dar es Salaam.
Prosecutors alleged that the move was aimed at "concealing or disguising the illicit origin of that money or assisting persons involved in the commission of the offence to evade the legal consequences of their actions."
Prosecutors said the businessman again bought 85m/- worth of mobile phone vouchers on December 10 with the same money laundering intention.
On December 21, Salum also converted 70m/- cash into recharge vouchers bought from Shivacom.
He then purchased another 20m/- worth of mobile phone vouchers from Selcom Wireless company, said prosecutors.
Other transactions involving the purchase of mobile phone vouchers were made on December 8 from Selcom Wireless (60m/-), November 29 from CHISS JR Company (26m/-), December 22 from CHISS JR company (77.5m/-), December 8 from Come and Call Ltd (90m/-), November 27 from Ace Distributors Ltd (35m/-) and November 26 from Freedom Communication Ltd (20.9m/-).

Alisema kuwa dalili hizo zinaonyesha wazi wananchi wa wilaya hiyo walivyo na imani kwa CHADEMA wanachokiamini ndicho chama kikuu cha upinzani hapa nchini.
“Hizi ni dalili njema kuwa wananchi wanakikubali chama chetu ndiyo maana unaona kwa muda wa siku tatu tumevuna wanachama 1,550, tuna kazi kubwa ya kutimiza kiu kubwa ya wananchi wetu,” alisema.

AS PRESSURE MOUNTS TO MAKE HUGE PAYOUT FOR AN ILLEGAL POWER CONTRACT
THE decision by the Ministry of Energy and Minerals to agree to pay Dowans Holdings SA/Dowans Tanzania Limited a staggering $65 million plus interest (approx. 100 billion/-) for an illegal power generation contract could have far-reaching and potentially devastating consequences for President Jakaya Kikwete's government, it has been revealed.
The Richmond/Dowans contract with the state-run Tanzania Electric Supply Company (TANESCO) was terminated following recommendations of a parliamentary committee chaired by the Kyela Member of Parliament, Dr. Harrison Mwakyembe, that probed the dubious power generation deal signed in 2006.
The report of Mwakyembe's committee, which was unanimously endorsed by the National Assembly, called among other things for the termination of the contract because it contravened the Public Procurement Act of 2004.
After carefully studying the parliamentary resolution, a team of legal experts at the Attorney General's Chambers concurred with the Bunge recommendations and the contract was duly terminated.
But in an unexpected move, the same Attorney General's chambers has now reversed its initial decision and advised the government to now pay Dowans more than $65 million for the same illegal contract.
"If the government pays Dowans, it means it has effectively gone against its own decision and that of the Tanzanian Parliament to declare the contract null and void and call for its termination," said a senior legal expert in government.
"Parliament declared that the Dowans contract was illegal. A parliamentary resolution to this effect was unanimously approved by all lawmakers. Any payments by the government to Dowans would contravene a valid parliamentary resolution."
There are sharp divisions among senior government officials, including Cabinet ministers, over a controversial ruling of the International Court of Arbitration (ICC) that ordered TANESCO to make questionable payments in favour of Dowans.
The Minister for Energy and Minerals, William Ngeleja, surprisingly announced that the government had agreed to pay Dowans as per the ICC ruling without even seeking prior Cabinet approval.
Under normal circumstances, Ngeleja would need to get the approval of Cabinet before making any final decision unilaterally regarding such a massive financial liability to the government.
Apart from creating divisions in the top echelons of the Kikwete administration and eroding the government's moral and ethical standing, the Dowans saga could have a devastating blow on the nation's economy.
"The Dowans situation has already caused shock waves in interbank trading. The market has panicked, thus pushing the shilling downwards towards further depreciation," a trader at a state-run bank told THISDAY.
Commercial banks quoted the shilling at 1,485/1,490 to the dollar last Thursday compared with 1,469/1,475 at the close of trading the previous week.
"There is a scarcity of dollars in the market right now. Therefore, an outflow of 65 million dollars from the market will mean the shilling could slide sharply to 1,500 or even 1,800 levels."
"Paying Dowans will mean exporting $65 million out of the country. This will seriously hurt Tanzania's economy."
A weaker currency could push up the inflation rate and undermine the government's goal of achieving a 7.2 percent economic growth this year.
"There is one golden rule about weak currencies – they affect the economies of poor countries like Tanzania that are import-oriented and carry huge debts," said the bank trader.
"This means that Tanzanians could end up paying more for basics such as food, consumer goods, kerosene and petrol, as a direct result of the Dowans payment. This is something that any sensible government should avoid."
While some government officials are seemingly in a rush to pay Dowans, the Minister for Finance, Mustafa Mkulo, has declared that government coffers have already dried up.
It has been suggested that Ngeleja's ministry and TANESCO could make re-allocations of their existing budgets and try to raise the $65 million, which government bureaucrats admit would be a difficult thing to achieve.
"TANESCO is cash-strapped and has huge debts. Where will the money come from to pay Dowans for a contract that is illegal in the first place?" Asked one well-placed government official.
Several government development initiatives, such as construction of roads and other infrastructure projects, have now been put on hold because of budget constraints.
Some analysts warn that the government could land in a political quagmire if it persists in paying Dowans for the illegal contract.
"Any payments to Dowans could have a major political backlash on the government. Parliament will need an explanation on why the government chose to disregard a valid Bunge resolution on the matter and there is growing public resentment on the move," said one political commentator.
“Donor countries are closely watching the government's next move and could free funds for the 2011/12 budget if it is revealed that the government squandered $65 million on an illegal contract.”

"This means that Tanzanians could end up paying more for basics such as food, consumer goods, kerosene and petrol, as a direct result of the Dowans payment. This is something that any sensible government should avoid."
While some government officials are seemingly in a rush to pay Dowans, the Minister for Finance, Mustafa Mkulo, has declared that government coffers have already dried up.
It has been suggested that Ngeleja's ministry and TANESCO could make re-allocations of their existing budgets and try to raise the $65 million, which government bureaucrats admit would be a difficult thing to achieve.
"TANESCO is cash-strapped and has huge debts. Where will the money come from to pay Dowans for a contract that is illegal in the first place?" Asked one well-placed government official.
Several government development initiatives, such as construction of roads and other infrastructure projects, have now been put on hold because of budget constraints.
Some analysts warn that the government could land in a political quagmire if it persists in paying Dowans for the illegal contract.
"Any payments to Dowans could have a major political backlash on the government. Parliament will need an explanation on why the government chose to disregard a valid Bunge resolution on the matter and there is growing public resentment on the move," said one political commentator.
“Donor countries are closely watching the government's next move and could free funds for the 2011/12 budget if it is revealed that the government squandered $65 million on an illegal contract.”

Appelant orally pronounced a divorce from his wife. Somewhat less than a month later, presumably in a period of “tuhr”, he orally revoked the divorce. The PC held that the divorce was complete and, on appeal, the DC affirmed acting on the advice of an assessor that the revocation was of no effect because the dowry had not been fully paid at that time. Neither court specified the school of Muslim law which the parties adhered.
Held:
1. Under the more common interpretations, divorce is effected only by three pronouncements and was not effected here, where only one pronouncement was given. Trial courts should specify the school of Muslim law which is applicable; in the absence of any indication to the contrary, it should be presumed that the more common interpretation applies.
2. Even if the single pronouncement was effective, the fact that the dowry had not been fully paid did not affect the validity of the revocation and the oral divorce was rescinded. Appeal allowed and respondent declared to be still the lawful wife of appellant.
2. MAHUNDYA MBURUMATARE v. MUGENDI NYAKANGARA (1969) HCD 7
26/11/2968 - Seaton, J.
Customary marriage – Validity depends upon the issue of a marriage certificate.
The respondent claimed compensation for adultery allegedly committed by his alleged wife. The question turned on the proof of marriage. The respondent argued that he married the woman in 1964, and that the marriage certificate was not regarded as necessary under the local customs.
Held:
1. The case falls to be determined under the Declaration of Customary Law, GN 279 OF 1963. Sec. 86 provides that the marriage must be legalized by the issue of a marriage certificate. The traditional ceremonies have no legal force.
2. IN the instant case, besides the non-production of the marriage certificate there were other discrepancies in evidence which indicated that there was no marriage between the respondent and the woman. Appeal allowed.
3. MATIKO CHABHA v. MATHIAS MWITA (1969) HCD 8 - Saidi, J. – 4/11/1968
Divorce – Return of dowry – When permissible.
This was a claim for the return of dowry. The parties were married under customary law, and the Husband had paid dowry. On divorce, normally dowry is not returnable once the children have been born, which was the case here. However, the wife has since remarried, and her father had received a second set of dowry.
Held:
1. Under Clause 52B of the Customary Declaration Order 1963 the claim for the return of dowry b y the husband on dissolution of the marriage cannot be entertained if the wife has borne him children. The Declaration does not touch on the relevant issue raised in the instant case, namely whether it is fair to bar the husband from recovering the dowry or a proportionate part thereof where the wife who has borne him children is divorced and having been re-married dowry is paid again to the father. This way a father could get several sets of dowry for the same daughter. In such a case the former husband is entitled to receive a substantial part of the dowry he has paid.

With due respect to his Lordship, this decision makes the wife look exactly like a commodity on the marketplace and not a human being. It is not fair and I think this was an erroneous decision, even then (1968). The dowry from the first husband or any subsequent husband for that matter was not supposed to be paid, with or without the appearance of children in the marriage!
4. RALANG MUMANYI v WAMBURA MWITA (1969) HCD 9 – Seaton, J. –
The appellant sued the defendant in the primary court in North Mara District for the return of bride wealth. There was evidence that after several years of marriage, the plaintiff’s wife (the defendant’s daughter) had deserted the plaintiff, but there was no evidence that the plaintiff had obtained a divorce. At the trial the plaintiff and the defendant gave evidence but were not allowed to cross-examine one another. It was not recorded whether or not they were allowed to call other witnesses. No issues were framed by the court, nor were the opinion of the assessors recorded. The trial court gave judgment for the plaintiff, relying on ss. 133, 134 and 140 of Law of Persons GN 279/1963, which provide that desertion is a ground for divorce and that the Husband may claim divorce and seek a return of bride wealth without legal obligation to search for his wife.
HELD:
1. After the Plaint had been read and the defendant’s statement in reply recorded, the court should have framed the issues in the case and determined whether or not the defendant admitted or denied the plaintiff’s allegations. [Citing r. 44-47 Magistrates Courts [Civil Procedure in Primary Court] Rules, GN 310 of 1964.
2. The trial court should have recorded whether or not the parties had been given opportunity to cross-examine and to call witnesses.
3. Although a primary court has discretion as to whether or not to sit with assessors [s.8 MCA Cap. 537], once the court decided to sit with assessors it must record their opinions and, if he disagrees with them, give reasons for his disagreement.
4. The section of the law of Persons cited by the trial court must be read together with s. 37A which provides that bride wealth may be required to be returned “in case of divorce.” In the present case, there was no evidence of a divorce and the award cannot be sustained.
5. ADMINISTRATOR GENERAL, ZANZIBAR, ADMINISTRATION OF ESTATE OF TOPAN KARSN RAMJI alias RASHID KARSAN RAMJI, DECEASED v. KULSAM FADHIL MUSSA & 5 ors. (1969) HCD 80 - 7/2/1967 – Kimicha, C.J.
The parties, children of the deceased, claimed a piece of property formerly belonging to the deceased. The Administrator General is the plaintiff in form only, belonging the action in court for instruction on the question of which of the disputants should receive the property. Mohamed Hussein claims the property by way of a deed of gift, made to him by the deceased, his father, in 1960. The deed gift was duly witnessed, but the deceased died without registering it as required by Zanzibar law. Mohamed’s sister argued that the gift was invalid for non-registration, and therefore that the property was properly part of the deceased’s estate, to be distributed among all the heirs.
One Ahmed Juma testified that he had been a tenant on the property since 1960, that the deceased in 1960 told him that he had given the property to his son and that the rent should thenceforth be paid to the son, and that he had since that time paid the rent to the son who issued receipts in his own name. One of the witnesses to the deed of gift testified as to its genuineness. The parties were Muslims, members of the Shia sect.
HELD:-
1. The validity of gifts and the distribution of estates is governed by Muslim law, where the deceased was a Muslim. “In civil matters the law of Islam is and is is hereby declared to be the fundamental law of the republic, under Cap. 3, s.7.
2. Mulla’s Principles of Mohammedan Law, para 150 (3), states: “If it is proved by oral evidence that a gift was competed as required by law, it is immaterial that the donor has also executed a deed of gift, but the deed has not been registered as required by the Registration Act.”
3. According to Shia Law, the requirements for a valid gift are:-
(a) A declaration of the gift b y the donor;
(b) An acceptance of the gift by the donee; and
(c) A delivery of possession to the donee. Since these requirements were complied with here, the gift was valid, and Mohamed Hussein is entitled to the property.
7. SHABANI v. SOFIA (1971) HCD 5 -/11/1970 - Kwikima, AG. J.
The respondent who used to live in concubinage with the appellant’s father sued the appellant for compensation of shs.9.120/= for evicting her from the deceased’s house which she used to occupy in his lifetime. The primary court dismissed the claim because the respondent and the deceased were Muslims and according to Islamic law, a concubine has no right to inherit part of the estate which a legally wedded wife is entitled to. Even under Chagga law which could be applicable were the respondent married to the deceased, Chagga widows do not inherit when there are male issues surviving as in this case. The district magistrate felt that the respondent was entitled to some of the estate after staying with the appellant’s father for 19 years and awarded her a quarter of the amount claimed.
HELD:-
1. With due respect this decision cannot be in accordance with the law. In suing the appellant, the respondent necessarily meant that the appellant had wronged her by depriving her part of the inheritance. How could this be if she was not entitled to any? Both Chagga and Islamic law exclude her from inheriting. According to Chagga law, she would not inherit in the presence of the appellant even if she was legally wedded to the deceased. She could not inherit under Islamic law either, being only the concubine of the deceased.
2. As this suit is not an administration of deceased’s estate matter, the appellant cannot be sued by the respondent. “Compensation” is payable by the husbands who divorce their wives or men who forsake their concubines with whom they have worked together and accumulated some wealth to be shared. In this case the appellant was the son of the man who kept the respondent as his concubine. The respondent could not therefore be heard to sue him.
3. Appeal allowed.
8. MANYASA v. MWANAKOMBO (1971) HCD 13- 20/10/1070 - Georges, C.J.
A divorced wife sued the husband for maintenance of three children. The husband died before the case was finalized. The district magistrate substituted the surviving widow for the deceased husband and made an order of maintenance against her at the rate of shs.50/= per month. On appeal, the learned judge set aside the order because the liability for maintaining the children of the broken marriage rested on the deceased husband and not on his surviving widow. The judge however, awarded the children a house allegedly owned by the deceased. When the divorced wife sought to execute the order, a claimant appeared who asserted that the house was his as it had been transferred to him years ago b the deceased. The chief Justice in this Inspection Note outlined the proper procedure to be followed,
HELD:
1. The divorced wife should have been advised to apply for execution under the MCXA [Civil Procedure in Primary Courts] Rules, 1964, s. 58. The Claimant could then appear and show cause why he should not be evicted. If the court rejects the claim, then the matter would be at an end, the order executed. If the court holds that the property in fact belongs to the claimant, then the divorced wife can appeal if she wishes.
9. IN RE: SALUM OMARI MKEREMI (1973) LRT 80, Mfalila, Ag. J. 14/5/1973.
1. The Law applicable to a “deceased native’s estate” [under Cap 30] is the tribal customary law of the deceased unless he had professed the Mohammedan religion and the court is satisfied from the written or oral declaration of the deceased, or his acts or manner of life, that he intended his estate to be administered according to Mohammedan law.
2. The deceased manner and way of life was far removed from his tribal customs, consequently the deceased estate should be administered in accordance with Mohammedan law of succession and not Hehe customary law of succession.
3. A Christian widow can inherit in the estate of her deceased Mohammedan husband and take 1/8th share as provided for by Mohammedan law as long as their marriage was one recognized under that law. [Administrator-General applied u/s 88(1) (b) of Probate and Administration of Estates Act.]
Page 354 of the HCD Casebook: Mrs. Nelly Mkeremi according to the above para. is Kitabia, therefore her civil marriage under the Marriage Ordinance to the deceased was a valid marriage recognized by Mohammedan law. She is therefore a “wife” under that law. If this is so then she is entitled to her share as a wife in the deceased’s estate. MULLA:- P. 234, Para. 259:
“a Mohammedan may contract a valid marriage not only with a Mohammedan women, but also with a Kitabia, that is a Jewess or a Christian, but not with an Idolatress or a fire-worshiper.”
s.19 (4) of JALO? Or Probate? - Notwithstanding any tribal or Mohammedan law to the contrary (b) a person shall not be deprived of a right to succession to property by reason of that person having renounced or having been excluded from the communion of any religion.
10. MANUGWA LUTALAMILA & 2 ors. V. MARTHA LUTALAMILA (1982) TLR 98 – Mfalila, J.
See MCA, sec. 320/1964.
1. In the administration of estates where the law applicable is customary law the Chief Justice is empowered u/s 14 (2) of MCA, 1963 to confer jurisdiction upon Primary Courts to administer the same.
2. Where the matter in issue is inheritance in customary law, then irrespective of the nature of the property involved, the Primary Court has jurisdiction unless the High Court has directed under section 88 of the Probate and Administration Ordinance that the provisions of that ordinance shall apply to the estate in question.
3. Under s.57 (1) of MCA, 1963 THE District Court is denied original jurisdiction to determine a matter of inheritance arising out of customary law.
4. The District Magistrate was wrong in declaring the proceedings in the Primary Court null and void and quashing them; he should have decided the appeal on merits. Order accordingly.
